Implied revocation of power of attorney

“A” the principal executed a power of attorney to "B" appointing him as his agent, but "A" the principal, exercised agent's duty when the power of attorney is in force. Whether it amounts to implied revocation of power of attorney? If yes pl give me citations. Thank you.

Adverse possession?

In a suit for recovery of possession, when the defendant pleads right of title of ancestral, can she plead for adverse possession by way of filing additional Written Statement?

Tenant's rights under pagdi system


We are staying in BORIVALI (mumbai) pagdi system from last 41 years. The landlord is recanting charge Rs.100 per month for rent collection charge. He is right for law in?And my room are is my father name he is dead last 10 years before & my mother also dead last 20 years before can is possible tenant’s rights transfer in my name ?. Can all tenants’ rights for repairer building without N.O.C. FORM LANDLORD. What are our rights? Recant landlord are racing rent by cheques. Cheques religion after some time is he gives me rent respite. i have rent receipt from jun-1970 recant also i am staying there with my wife & my two kids . my landlord are so oldge he is 90 years old and recant he make bypass surgery. So he is retired. Take our all matter landlord son. I ask if any time landlord are dead than can any problem from landlord son.plz sir / madam give me your value bal advice i am so poor man . I am so ham full. plzzzzzzzzzzzzzzzzz

Can a seller sell goods with condition that they will not be sold further for 5 years?

Indian Ordnance Factories sells its pistols to arms license holders as regulated by Arms Act 1959. At the time of sale of pistols to arms license holders, IOF puts a stamp on arms license that the pistol sold by them cannot be re-sold by arms license holder for 5 years commencing from the date of sale.

Questions:

1) Since sale/resale/transfer etc. of firearms is regulated under the provisions of Arms Act 1959, does this act of stamping a condition for resale on license by manufacturer have any legal force? Does IOF have any right to override the provisions for resale of arms as provisioned under Section 5(2) of Arms Act 1959?

2) Regardless of this IOF stamp on license, is it legal to sell such firearm after giving 45 day notice as per Section 5(2) of Arms Act 1959? As per Section 5(2) of Arms Act 1959, arms license holder can sell his arms after completion of 45 days notice period given to the District Magistrate or Officer Incharge Police Station. Regarding payment of cpf after dismissal

can anybody tell me plzz..is there any rule of getting the full amount ( with contribution of department,under CPF ) after the case of dismissal from government job...where all the recoveries put by department has already been paid...i have got only my contribution towards cpf,department hold their own contribution..plzzz help me out.. i am very confused..no one is sure on this topic..the lawyers with whom i talked they are saying that it is possible that employee can get full contribution..but i am not sure bcoz all lawyers accept the case only for money..plzz give me right information regarding my query...

How much rupees bond required

One X is authorised by the Board resolution of the company to look after the entire affairs of the company. Now X wants to execute power of attorney in fovour of Y for some specific work in the government e-govenance department in karnataka. I want to know what amount of bond is required. or can it be on letter head?

Consumer protection- fraud by packers and movers

Hi Experts,

I transported my household goods from Mumbai to Delhi using a packers and mover company. I specifically asked for insurance and declared the value at Rs 80,000 for the goods. The packer loaded all the goods from Mumbai and give me a bill of loading. I asked for the insurance receipt but he said that he needs to put in the vehicle number in the insurance, so it would take 2 days to receive the policy. In the receipt for the payment I made for the consignment, he wrote "including AIG insurance" and signed it once more when I insisted, next to the total payment. I paid the entire amount in advance. Now I received the goods in Delhi and a lot of the goods are missing or broken. The packer kept delaying the insurance receipt and never sent it. Now he has stopped picking up my calls.

1) I think this is a fraud where they took additional money for insurance and actually never got a transit policy from Tata AIG. As such, what should be my next course of action? Should I file a police report first or approach consumer court?

2) The company is based in Mumbai. He contracted another local mover in Delhi to deliver my goods. Now both companies are blaming each other for the damage. If I need to file a complaint against the Mumbai based company, can i do so in the Delhi consumer court? Or will I need to go to Mumbai consumer court to file this?

3) Can I file the complaint against the Delhi company as well? Given that I contracted with the Mumbai company who subcontracted it to the Delhi company, who should be ultimately responsible for the loss?

How can one change is signatures if it is already provided in most places like banks/passport etc. Is there some legal method to it like change in name .

Complaining against dy. registrar & lokayukta ?

Dy, Registrar of co op societties & Lokayukta of Maharashtra are important institutions created for public but are ineffectice and corrupt resulting in wastage of money and time as most of the time appoiontee is a favourite of some politicians and just draw salaries and perk but does nothing. Where to complaint against these thugs ? There has to be a way / forum. Anna Hazare righly saying that we don;t need Jokpal and Jokayukta as they are mere peons of politicians.
