Sir,
My husband has filed a suite for his share in ancistor property which is situated in his native place. Along with that he as filed for declaration of self acquired property in the same place. We are living separately since from our marriage ie.,1991 in bangalore and we are having separate income as we both are working for a public sector organisation. The suites were filed in 2007. My husbands brother who is residing in the house constructed by my husband in his self acquired property for which declaration suite has filed. Even my father in law is also residing with him. They both are disputing that the self acquired property also belongs to joint family since partition of property is not yet taken. Further they are producing some false evidences such as tax paid receipts electricity meter purchase receipts etc which were intentionally build up by him which we came to know during the course of cross examination. We have not taken any loan for construction of that house. But we are having the sale deed for the self acquired property and also the khata is in my husbands name. Further my husbands sisters who are married have also filed for their share in the ancistors propertey. They both are not disputing for self acquired property. Hence can my brother in law and father in law both have right on the self acquired property. how long this case may take for settlement.

I came to understand that domicile certificate is a necessary document for a student for getting an admission in junior college in Mumbai.
I am in Mumbai since Nov 2006. My son needs to get an admission in junior college this year.
As per the rules explained by the officers, domicile cannot be given as the tenure of residence in Mumbai is not sufficient.
What shall be the lawful way to get an admission in Mumbai Junior college?
Anticipate help.

I am looking for a lawyer in Mumbai who can handle a case of noise pollution. I have a decibel check report from the government environment department. The noise levels are very high than the prescribed limit. BMC and police are simply delaying my case.

ONE ADVOCATE ACCEPTED THE VAKALATH. THE CLIENT PAID Rs.10000.00 TO THE ADVOCATE. THE ADVOCATE DID NOT ISSUE ANY RECEIPT TO THE CLIENT. IN THE MIDDLE OF THE CASE, HE WITHDREW FROM THE CASE BY REPORTING NO INSTRUCTIONS WITHOUT THE KNOWLEDGE/CONSENT OF THE CLIENT.
THE CLIENT APPROACHED THE CONSUMER FORUM FOR DEFICIENCY OF SERVICE. NOW THE ADVOCATE SAYS THAT, HE HAS GIVEN FREE SERVICE AS SUCH THERE IS NO CONSIDERATION. HENCE THE COMPLAINT IS NOT MAINTAINABLE.
WHAT TO DO WHEN ADVOCATES TAKE THE FEES AND DO NOT ISSUE ANY RECEIPT/PROOF. IN FUTURE, ALL THE CLIENTS MUST AND SHOULD DEMAND RECEIPTS FOR FEES PAID TO THE ADVOCATE.
PL.GUIDE ME.

Production of documents
A recovery suit is filed by plaintiff against deft. At the time of filing written statement by deft. xerox copies of certified documents (in respect of earlier proceeding U/s. 138 of NIA wherein deft. is acquitted) & notice reply to the demand notice of plaintiff were produced on record. Plaintiff's evidence is over. Deft. at the time of filing his chief examination filed original certified copies & office copy of notice reply (as mentioned above) alongwith an application for production of documents on which court called other side's say. Plaintiff relied on AIR 2002 SC 100 (Madanlal Vs. Shamlal) and rejected application of deft. for production of document. Particulars of those documents are mentioned in chief of deft. Now those documents are required to be exhibited but how ? Whether Madanlal Vs. Shamlal is over ruled ? How those documents can be exhibited as production of same is rejected ?
