I Have filed a civil suit against X and he died and is it my responsibilty to give the defendants LR`s name and address...
and please advise me further
Background :
The Plaintiff has filed two civil suits: Small Causes Court and Special Civil Suit.
He has submitted the Original Assignment Deed made by him in the Small Causes Court and in the Special Civil Suit he has submitted a fresh registered copy of assignment deed as Secondary Evidence ( This is not the photocopy of the original one)
Facts:
In the Special Civil Suit he claims the property on the grounds that he is the owner and as a proof of his ownership he has submitted the Secondary Evidence of the Assignment Deed ( registered copy of the deed and not photocopy of the original deed).
On comparing the Secondary evidence with the Original deed it was found that the original deed contains some cancellation in excess stamp duty ( around 6 lakhs refund)and a stamp endorsed by the Collector ( this page is not stamped by the registrar of Havell i). This transaction and the endorsed stamp of the Collector is missing in the Secondary Evidence although it is a registered copy from the Havelli.
Note:
In both the suits the Plaintiff has not submitted the Index II of the property which contains the remark from the Collector about the transaction and refund of money. And mentioning that the plaintiff had made an application for the refund.
But in both these cases the Defendant has submitted this Index II.
In My view:
As the entire Special Civil Suit is based on the grounds of the ownership of the plaintiff and that is relied only on the Secondary evidence and since the Secondary evidence does not match the Primary evidence hence this Secondary evidence be challenged and this case will not stand as the Secondary evidence is not valid.
Question :
Can this Secondary evidence be challenged in order to achieve this goal ?

our house is on society leased plot, which was on mothers name. After my mother's sad demise ,Myself and my sister,we both are the only legal heirs....Sister is in possession of this property as I am posted outstation on transfer.
Now sister has pulled out mother's WILL suddenly from nowhere and submmitted it to society because in the, WILL mother has given entire property to my sister....Every body knows that ,the WILL is null and voied for certain reasons....Considering my equal claim submmitted,Society has asked my sister to obtain "Probate or letter of administration from civil court.
Since my sister is in possession of the property, she will not be planning to go for probate, fearing the heavy stamp-duty.Now society is not making both of us, members of the society without probate..... Altimately,I am the sufferror....My sister ( is in possession) and the society will keep mum for ever, (Lease is for 999 years).
Is there any law that, the probate has to be taken within so many days for regulerising our claim by society.Otherwise the bottleneck will remain for 999 years. Is it so.????????????

Dear Sir,
In our case for one of the SLP the limitation of 90 days ends on May 31,2012 during which the SC is in vacation. The SC shall resume office on July 2, 2012. Whether the limitation of 90 days get extended by the vacation period or the 90 days has to be strictly followed. If the SLP is filed after May 31, 2012 but before the vacation, whether the same shall require a condonation application.

Unable to construct house due to exigencies of service. any saving point under land acquisition act
I have studied the Land Acquisition Act 1894 and the importance of serving notice under Section 9 of the Act has been emphasized in a few case laws and in others this was not considered as important. The Section 9(4) reads:
“ In case any person so interested resides elsewhere, and has no such agent, the notice shall be sent to him by post in letter addressed to him at his last known residence, address or place or business and [registered under sections 28 and 29 of the Indian Post Office Act, 1898 (6 of 1898)].”
What is the remedy available to a landowner who was serving away from the state where the acquisition process had been initiated and culminated in prescribed two years period and such a Land owner comes to know of it only after Three Years of the date of Award passed what can be the remedy to get his intended place of residence back and when he can not buy out the compensation money even the land for his grave and he is already a senior citizen.
I am a registered Advocates and want to conduct the case my self. I am the affected party as well. Please advise with any case Law covering my situation.
