It is said that the Probate Court doesn't confer about the title of the property mentined in the WILL submmitted for Probate. Is it true ? and if yes then...
What happens if executor of the WILL seeking probate, files an affidavit in the Probate Court, which contains false information about the present status of the property mentioned in the said WILL ?

Summary of case:-
I. Lt. Mr. .Verma was revenue accountant in department of Haryana state electricity board, .He was appointed as incharge of audit party NO.52 for the office of board’s subdivision during the period of 12.10.89 to 12.06.90.
II. As on 7/4/94,Mr.Verma received a charge sheet from the HSEB(Now DHBVN)that there was laps of duties during the audit word did by audit party.
III. Summary of charge sheet:-Mr. .A.K.Jain was appointed as a consumer clerk in the office of Nue subdivision of board ,he has been embezzlement a huge amount of money during the period of his service when he was on this seat , in the period of 12/10/1989- 12-6-90 , when Mr. Verma was appointed as auditor he embezzle Rs. 40000/- and Mr. Verma and his team had not detect this amount during the procedure of audit.
IV. Mr. . Verma submitted a letter to board please give the original record for consultation or for the reply of charge sheet on board expenses , but the charge sheet show a clause that Mr. Verma may consult original record on own expenses, no TA and journey expenses pay to Verma for this.
V. During the 1994-1998 there were a lot of correspondence between the board and Mr. Verma that please amend this clause of charge sheet that Board will pay the journey expenses as per rule of Haryana govt law and legislative department chapter 6 page 52 .
VI. 7/5/98 board was amended the clause of charge sheet and gave the permission to Mr. Verma that he can to consult the relevant record on board expenses as per rule
VII. 6/5/1998 board issued a office order that the two grade increment of Mr. Verma has been stop with future effect and board has not given any perior notice and opportunity
VIII. 8/10/1998 appeal against this order that Mr. Verma submitted to board has rejected .
IX. In 2000 Mr. Verma filed the suit in hon’ble high court against this order.
X. this time high court admitted this appeal and case is pending.
XI. Now in the year 2012 Mr. Verma has been expired with heart attack .
Now all these case show that a huge financial loss had suffered by Mr. Verma during the life and now his widow suffering from this huge financial loss in family pension.
Now the main query is that tell me any procedure for early hearing for this case for widow of Mr. Verma.
One point also in this case Mr. Jain embezzled huge money during the period of his service and in other period a other auditor also failed to point out Rs 100000/- and on the same date board give other order against Mr. . tiwari that you will pay 10% of total amount that you could not detected during the course of audit.

As per Section 139 of the CPC, under rule 391 (the Marking of a Will) - Every will, copy of a will or other testamentary paper, which is sworn to or affirmed by an executor or administrator, shall be marked by the person before whom the oath or affirmation is made.
I have unofficially received xerox copy of an allegedly Registered Will with the Sub-registrar's Seal but no signature or Official's stamp
. As per the Mumbai High Court (Side Rules) updated 27th May 2009, Chapter XII, P 197, dealing with Affidavits, a Court Officer must initial or sign a sworn document, so as to be able to testify later to verify the document.
The Will does not contain any individual identification of a Court officer, but merely a stamp. How legal/valid is the Registration of this Will Document ?

My landlord wants a 1 month(30 days) evacuation notice clause in a 11 months agreement to which I(tenant) have opposed.
Is it legal to give 1 months evacuation clause in an agreement that is valid just for 11 months?
Isn't the 11 months agreement supposed to be honored by both landlord and tenant for the whole of 11 months?

Sir,
My friend had a land in Gaothan area in his father`s name . He planned to build a bakery there. So, he got his project loan sanctioned by the nationalized bank But the bank after sanctioning the loan for bakery failed to disburse the amount in full despite of several requisitions and follow ups & without giving any clarification for the non disbursement of the loan in full and on the contrary pressurized his father to pay off the disbursed amount. So,his father had to sell the land for the minimum amount, far below than the market rate to the local person who had threatened him to kill. after two years from the date of sale,When my friend who was working in Banglore, returned , his dad revealed this thing to him. My friend is the only son and did not ever give his permission or NOC to sell the land. What are the legal remedies available to him to prove this deal illegal thereby cancelling this deal & acquire his land back? What is the time limit available for him to take action after the sell of the land?

I have filed a review petition u/s114 CPC on the grounds of S44 Evidence Act viz. fraud, collusion of judge with plaintiff and incompetence of court i.e. no jurisdiction. The question is:
1. is it maintainable as a separate Miscellaneous case in the same court or does it necessarily have to be filed in the same case in which the order has been passed?
2. since petitions under s44 alleging fraud, collusion are unfettered by limitation, can the court reject the Misc review petition on the grounds that review has to be filed within 30 days of the judgement u/s 124 of Limitation Act?
3. if the sole document relied - a so-called sale deed - on by the plaintiff has not been specifically admitted, endorsed and exhibited by the Court, is an order based on that doc sustainable?
