Sir,
If any settlement is arrived at between parties before Lok adalat with regard to compensation under land acquisiton act after compensation is enhanced by reference court, will the settlement be operative for other cases under Section 28A of land acquisition act?
If lok adalat observes that the settlement will not prejudice the other cases will this take care of Section 28A of land acquisition act?

An injunction is obtained from the magistrate court by the tenant for not vacating the premises. The injunction is an interim injunction till 13-oct-12.
If an interim injunction is passed and the the validity of the injunction obtained is till 13-oct-12,is the injunction still valid.
Thanks & Regards,
Ramesh
Very recently I have learnt about existence of my father and grand fathers will, fabricated and made by my uncles.
i have discovered photocopies of some documents wherein there is reference of these forged wills.
Acting upon the information discovered by me, i sent a notice thru my legal counsel to my uncles for production of certified copy of the said wills.
they replied that as the matter is too old they cannot instantly re-collect the entire issue and simultaneously asked me to let them know that how I learnt about existence of such will, with a further request to send them a copy of document or any evidence which I had regarding such will.
Then i published a public notice in newspaper claiming to be legal heir and inheritor of properties left behind by my father and grand father.
In reply to this public notice they have sent me a notice thru their lawyer in which he refers to (Forged)wills of my father and grandfather wherein allegedly both of them have bequeathed their properties and shares in properties to my uncles.
My lawyer has written to my uncles lawyer to forward a copy of the alleged wills and the same time denying existence of any such will and further alleging them to have been set up by his clients, i.e, my uncles, to usurp the properties.
their lawyer is not replying to my lawyers letters nor he has sent the copy of will to which he has been referring.
MY UNCLE MAY TRY TO MISUSE THE FORGED WILLS FOR TRANSFER OF PROPERTIES IN THEIR NAME.
how to stop possible misuse?
what shall be my course of action?
Shall i sent a complaint to police authorities?
to whom shall I write / inform.?
I have sent an objection letter to the registrar's office that there is no will left behind by my father and grand father so no property transfer shall be done based on any wills even if produced before his office, before allowing me an opportunity to take legal action.
properties have yet not been transferred, and they stand in names of the legal heirs of the deceased, i.e, my brothers and sisters.
An attempt is being made by the uncles but they have become cautious since receipt of the legal notice.
the will are forged and no probate has been obtained.
forsenic tests shall reveal.
i have further reminded the registrar that despite my objection, if he allows the transfer to take place- he shall not be able to avail immunity under section 86 of regn act, 1908. as it will no longer be an act under good faith, as he has been informed.

my brother , a defendant of a case filed by me has despite giving an affidavit to the high court that he shall use certain premises only for residential purpose and not guest house has been openly advertising the guest house on the internet at 3 websites for over a year in violation of the affidavit.
we have taken google dated screenshots showing the dates on which the ads were issued
he continues to do so.
earlier he gave the same affidavit at a trial court and subsequently it was establbished thru report of the local commissioner that a guest house was running
thus from nov 2009 after giving an affidavitg to lowere court and again in oct 2011 after giving an affidavit to the high court this comtept continues.
i propose to file an appliction for comtempt of court.
kindly let me know what relief i shall get for continued use of floor as a guest house in violation of the affidavit.
i own the floor on which the guest house is run and i have filed a suit for possession,
can the court order that mesne profts at guest house ratees would continue to be provded to me till the guest house operates.
what other penalities can it impose?

sir
Apart from his own properties, my father during his life time acquired several immoveable properties in my and my mother’s name but from our own funds. My father has expired. My younger brother was vagabond so my father has not given him any of his property which he has clearly mentioned in his WILL.
Now my brother has filed a suit in court claiming that all properties belonging to my father, myself and my mother form joint family properties of my father and he is entitled to his share as member of joint family in all properties and asked for partition decree and injunction order restraining us to deal with all properties. None of the properties are in his name. They are either in my name or in mother’s name.
A copy of suit plaint, Annexure, notice of motion etc. is sent to me as part of legal procedure. Though he has put many annexure with plaint or notice of motion they are not relevant and he has not filed any relevant supporting document or exact proof which can establish his claim. Our lawyer has asked his lawyer to give copy of documents which he is relying for his claim.
1) Is he not supposed to annex all relevant documents now for establishing his claim and prayer for injunction or he can produce them when injunction application hearing begins, just to catch us off guard or surprise us?
2) Is his lawyer bound to give us documents on which he is relying (which he might not have annexed), if my lawyer requests for it?
3) Am I correct in assuming that all documents, proofs should be disclosed, annexed before injunction application is fixed for hearing? Matter is in admission stage and ad-interim, interim injunction hearing will start soon.

Sir
I had lodged accident claim for my motor car with Bharatiya AXA insurance. The claim was for Rs. 34900/- but they had sanctioned only Rs. 20300/- and accordingly had sent cheque of this amount without details. I had asked for details as to how they have finalized claim and then I planned to appeal to their higher authorities. In the meanwhile if I deposit the cheque in my bank would it amount to my accepting the claim and do I lose further rights to appeal? Should I not deposit cheque? Validity of cheque is very near. What should I do with the cheque?
