Civil query

Dear Sir,

In a suit for recovery of the rental advance, the Tenant (P/f) was given only with the copy of the rental agreement. defendant(land Lord) had also admitted the execution of the same and the receipt of the amount. Now my query is that what is the procedure to call the defendent to produce the original rental agreement. Note that the suit is posted in the special list for trial. Kindly guide me whether I have to file a affidavit Petition for the same (if so, under what provision of law) or I have to give notice to the defendant's counsel under O. XI R. 16.

Can contempt petition be filed before another court in whose jurisdiction the petitoner resides.

Dear Sir(s)
I filed OA No. 442/2009 before the Hon'ble CAT, Ahmedabad Bench and the judgment was in my favour but before the same could be implemented I got transferred to New Delhi. Now the respondents have not implemented the said judgment within the time limit fixed for its implementation. Can I initiate Contempt Proceedings in the Hon'ble CAT, Principal Bench, New Delhi for implementation of order passed by the Hon'ble CAT, Ahmedabad Bench since I am now posted and residing in New Delhi. Please advise.

Civil

In a civil suit the plaintiff submitted in his plaint and again in his replication that the name of respondant has been included in the khatauni of disputed land by the error of the revenue staff. Plaintiff says only this , he has not explained how and when the said error was committed by revenue staff , he has also not submitted any document to prove this allegation . Can the respondants file an application in the court and pray the court for asking the plaintiff to submit the details of this allegation (i.e how and when of the said error)so that the respondants can object the allegation . If yes than under which law this application can be filed. If plaintiff fails to sumit the detail than what can be done against him and under which law. Thanx

Application under section 151 of cpc

my land was sold by forged signatures and criminal case is pending. i have filed a civil suit against the purchaser for declaration, possesion and permanent injunction. During the case, I applied under order 13 rule 10 cpc to call original records from criminal court to prove the case by primary evidence. The same was rejected after hearing and court supported the objection of defendent and it was ordered that the case can be proved by certified copies and it is not necessary to call original records.I moved another application for the same under sec.151 cpc which was again rejected on the ground that the court can not review its own order and it is already time barred for the review (although the same was not a review)Defendent again objected and submitted that secondary evidence is sufficient.Recently I have again filed an application u/s151 cpc pending for arguement if this also gets rejected then kindly advice
(1) Can I move an application for permission of certified copies to be exhibited u/s 65(c) of evidence act?
or
(2) Should I file a writ under article 227 of the constitution with the high court?

We have been advised that if we prove our case through secondary evidence then it will be quashed in the first or second appeal.what should we do please enlighten us.

Succession certificate of bank locker

My Client lives in the UK and a bank locker stands in a nationalized bank in the name of her deceased parents jointly. She is a single child. The bank intimated in writing that she would require a succession certificate. The law says that SC is not required if there is no nomination. My client says she is not made a nominee according to her knowledge. Therefore if a SC is applied for, how will the stamp value be determined? Secondly how do determine the stamp value of share certificate, is it on the face value or the current market value?
