Sir/Madam,
My brother joined in bank Service as a Clerk in the year 2010; Later he cleared bank exam and got selection in po. In his previous department he was allotted PRAN number by NSDL. As he thought it would be difficult to get NOC from bank, he had not intimated about his appearance in bank exam. Now he also not disclosed the fact that he was a central government employee to his newly joined department as he does not have a NOC. Whether his new department will trace the fact while allotment of PRAN number? If yes, what should be done in this regard? Please advice.

I have given an amount as advance to a house owner to occupy his house as a tenant. He has also given the receipt to the paid amount.I have not entered into any agreement yet. Now the problem is that we cannot move into that house right now because of security problem. The locality is new and not developed still. In the night it looks insecure as there are no houses around except for only one in front.
I told the owner about my inability to move to that house and asked him to return back the advance amount. But he refusing to pay. I want to know what action can be taken to claim my money back. please tell the steps that can be taken.

A very old MHADA LIG establishment is being redeveloped. There is a triparty agreement between MHADA, builder and the society (670 members). All the legal formalities regarding the project are done and the construction is in full swing.
The existing owner bought the tenancy rights from one of the original members in the society in 2010 and got his name registered into MHADA and the society records. The builder has paid a one time lumpsum amount of X to each of the society members earlier this year and is also paying a rent of Y amount every year to each of the society members. The existing owner now wishes to sell the tenancy rights. Payment would need to be done from personal savings, no bank loan possible but its a lucrative deal and hence, giving it a thought.
My questions are:
1. Is it safe to do the transaction at this stage, considering that the existing owner would take care of getting my name registered into the society and MHADA records.
2. What legal documentations need to be done to safeguard my interests? Is a NOC required from the developer?
This is considering that the developer would transfer the flats to the society members and as such whose ever name is present in the society records is entitled to recieve the flat. Does this argument hold true?
3. Since this is used to be an LIG establishment, do I need to be in the LIG category in order to purchase the tenancy rights?
Dispute over common facilities with neighbour
Dear Sirs,
Kindly advise on the following.
We and our neighbour have plot of lands adjacent to each other. We have built common building on our plots. Staircase, water tank and entrance are common. Underground water tank is in neighbour's plot. Entrance and stair case occupies the parts of both plots. Building is designed in such a way that his flats come in his plot and our flats come in our plat. We have made joint expenditure for these facilities & construction.
We have not made any agreement to this effect. Except we have made agreement on Rs.100 stamp paper with contractor for building construction which covers these costs.
We have dispute over common things. Neighbour is asking us to make separate water tanks. Making separate water tanks, pipelines is costly and we do not wish to make it.
We have other small water tank to the back side of building in his plot which is common. He is denying it that it is common.
Kindly advise as to
1. Can our neighbour restrict us from using common water tanks which are in his plot of land.
2. What civil and criminal remedies we have in case he obstructs us from using water tanks.
Thanks
