Contract of sale

A promoter has constructed a Building of G+5 whereas he has got the sanctioned plan of G+3 and after the deviation from the main sanctioned he has already applied for the deviation plan 24% p.a. with the Booking money if he could not get the NOC from Municipality against the Deviation upto June, 2013.
Should the person go ahead or not.
Suggest on urgency basis what else clause or action to be taken should be mentioned in the agreement of Purchase of Flat with the promoter.
And also suggest weather the Roof is considered as the common passage included in the Super Builtup if the Agreement or sale Deed is Silent about it.

Is an arbitration award copy a document???

Dear Sir / Mam

Can I say that an arbitration award (mainly award copy) is a DOCUMENT?????

…I am being specific to term it as a document as a document can be held to be a void document (I don’t want to say that it’s a void award)…

If a void document is attached to execution proceedings, the proceedings don’t stand…

Also if I lay emphasis on the word ‘document’, then I can co-relate with Contract Act, Relief Act & other acts which emphasize with the word ‘document’

Thankyou

Will (a real and interesting case to answer)

chand devi given her portion of land to her grandson chaman lal on rent @ rs. 500 pm in 1985. She also resides with chaman lal. she died in 1996 and leaving her portion to chaman lal who also borne her all medical expenses. Chaman lal used her portion without any hindrance till 2012. But now in 2012, sham kumar brother of chaman lal showing registered will (dated 1986) of chand devi in favour of sham kumar and asking chaman lal to vacate portion of chand devi. Now querries are: 1. In doughtfull registered will of chand devi, name of chand devi w/o Om parkash is written as chand bai w/o Om parkash. But in fact her name was chand devi. Signature on will is also as chand bai. I want to plead the case on this point that will is forged and not made by genuine chand devi. How strong my point is? May i have case law on this particular point.

2. witness on the will is of mukesh who is relative of beneficiary i.e. sham kumar. witness of relative of beneficiary can be taken as valid?

3. Can it be a strong point, that why sham kumar did not shown this will in 1996 immediately after death of chand devi. why he kept mum for so many years.

Pls interact and guide.

Gs land

Dear Sir/Madam,

Mere village me gs jammen se hokar ek rasta mere ghar tak aata tha. Jisake ek taraf khet hai aur dusari taraf ek makan hai jisaka kuchh portion GS jammen me hai aur kuchh khali GS jammen ko boundary banakar kabbja kiya hua hai.

Jo sadak mere ghar aa raha thi use jisaka khet hai unhone use CRO se order karwa kar tod diya hai.

Aur makan wale ne high court me request kar k GS jammen ko apane nam karane aur usake badale me penality jama karane ki apil ki aur high court ne nirdesh diya hai hai ki agar o jameen agar aam rasata na ho ya talab ya ghur ghadda na ho to inake nam pe karane ka vichhar kiya jaye. Legpal ne galat tarike se report laga kar ke o jammen unake nam par kiya aur Rs.70000/- ki penality gram sabha ke a/c jama karawa diya

Usake bad hamane CRO ke office me darkhash diya aur CRO ne jameen ki ragistry pe stay laga diya hai

Isi raste se lagi hui kuchh GS land mere ghar ke samane bhi hai.

1. Kaya mughe wahan se phir rasta mil payega ki nahi ?

2. Mughe aur kaya agala kadam uthane chahiye ?

App sabhi ki ray prarthniy hai
