Hello Members
Eviction petition of one shop filed by two landlords on the ground of personal bonafide necessity of their respective sons, the same was dismissed as withdrawn without permission to file a fresh petition.
Second eviction petition was filed by both the landlords/brothers for personal bonafide necessity of same son of one landlord only after one month.
Whether second petition is not barred under order 23 Rule 1 CPC and section 14 of Haryana Rent Act?

In LE suit in small cause court, one of the new issues framed is about valuation and stamp fees paid.
The plaintiff has paid Rs. 15000/- only whereas the property's value is 8 crores.
Can the suit be heard if correct stamp fees are not paid immediately? will the suit be dismissed if correct/balance court fees are not paid?
2. The plaintiff has not even filed evidence for over 2 years and the defendants have filed evidence and given inspection

I am thankful to all esteemed lawyers who have replied to my query.
I have to add further here that the Pan thela in his plaint of civil suit is only saying that he is in possession since 1969 and he knows the about litigation going on and final decision about the main shop case. He is no where saying that he is a tenant of my partner or me. He is more worried about eviction of his portion of the ( 3ft X 2ft ) of Pan shop. Original Water bill & Electricity Bill still stands in my Grand Father's name. Pan thela has taken a separate Elec Meter in 2004 in hin name as Gupta Pan Mandir and he is paying corpn Tax since 2001. The partership between and my Grand Father / Father & main shop ( other than pan shop) was on Rs 5/- stamp paper that too unregistered proved in Bombay H.C. One more valid point which HC ( Hon.Justice Arun Choudhary ) mentioned in their order is that shop is earmarked for refugees from Pakistan and no body else can be owner. Now Pan thela wala is claiming ownership by vitue of possession since 1969 & my father's innocence to the extent that one day this Pan thela wala may also claim ownership of his portion in the main shop of 240 sq ft. I think matter is more clear now.If still more details are required you can mail me on charanjit.khurana@gmail.com

But I do not know if the proposal has been accepted or rejected. Please let me know, if any of the experts have an input on this. Below is the link of the website where the report was published.

Joint property equally divided to all legal heirs after the dead of parents. One brother filed civil suit (Permanent Injuction) on the basis of simple affidavit of late year almost 17 years old that the said property is given to him by all members duly signed on the simple affidavit of Rs.3.00 attested from notory. Court gave interim stay that property shall not be sold by any member. Although the court has passed order almost 4 months back my advocate did not appeal and also avoiding to contact with me. I fear something doubtful and in opinion to change the advocate. My query is that next date in the court is next month of first week. If I engage another advocate can he appeal in the present order passed by the court since the property is duly registered and mutated as per revenue records on all legal heirs. Please advice urgently.
Recovery suit
Respected Experts,
There was a joint postal MIS Account of X and her father-in-law. Father-in-law expired. Post made payment to X, being the surviving account holder. Legal heirs of father-in-law of X have filed civil suit for recovery. Now, the money is in the hand of X, who is a female. Can she get advantage of Section 14(1) of Hindu Succession Act 1956, to claim that she is the absolute owner of the money? Would you please give me case laws in pdf format, supporting this contention? Request you all to extend cooperation. Regards.
