Partition suit and final decree

Sir,

I filed final decree proceedings for my 2/3rd share in the partition suit which belonged to my mother and other 1/3rd share to my sister. I filed partition suit against my sister long back 17 years ago, now suit is coming to an end after passing of preliminary decree by High Court.

My sister who is admant and criminal minded occupied the whole property by filing false unregistered reqlinquishment deed which I contested her petition for sending for stamp duty subsequently dismissed. Again her daughter filed third party claim petition claiming she is the absolute owner of the property before filing the partition suit. My sister and her daughter filed petitions under Sec 47 C.P.C., Sec 45 of C.P.C. Section 151 C.P.C.

My counsel contested before the judge that the petitions are not maintainable. My sister forcibly resisting the final decree inspite of having clear order "final decree proceedings to be completed within 3 months from the date of this order" in C.R.P. by High Court.

I would like to know what will be the status of my preliminary decree passed by the High Court and subequently appealed and dismissed against my sister in the Supreme Court of India. Can court allow my final decree proceedings and appointment of advocate commission. What is the maintainability of petitions filed by my sister to stall my final decree proceedings.

Kindly advise me for which I will be grateful to you.

Thanking you,

MSN

Deface private property

Hi,

I have a query, this is related to my property. Is it ok for someone to write court case number on my property without my permission.

Does this not amount to defacing of property?

Please advise, I am being subjected to such harassment where some unknown person has been writing case number, while I try to ensure my property is not in any way spoilt

thanks

How to get consumer forum deposited decretal amount compliance by respondent

Sir

In Aug 2009 I filed complaint in consumer forum which got disposed off on Sep 2011. Then on Oct 2011 I appealed against the district judgment in state commission. During this appeal period the respondent deposited the amount in court with interest which they have taken from me(i.e. compliance of district order). In Oct 2012 my appeal got dismissed by state commission and being aggrieved by the impugned order I filed revision petition in NCDRC which is still going there (under process).

Question.1 Now how can i take back the amount deposited in district forum by respondent.?

Question.2 will respondent object over it since my petition is still going on in Ncdrc.(i.e till finalisation of case)?

Ht overhead cable passing thro lands

Sir,
I have some cultivable lands. I understand that the Government is planning to install H.T.Overhead Cables in that ares. Though as it appears today that there will not be any posts are planned to be installed in my land, yet, certainly the overhead cables will pass through my lands. It is learnt from the local people that this will reduce the salable value of the lands. Is there any thing I can do in this? can I stop this in any way? Or can I get any compensation for this [ for use of my lands to draw H.T.wires. I need your expert opinion as to how to proceed. Thanks in advance.

Will

Dear Experts,

In Lokadalath my father agreed that after his lifetime his property share in the joint family properties shall goes to me.For this,an award has been passed. After some months I came to know that my father is planning to give his property share in the joint family properties to my brother through WILL,which is against to lokadalath award. My father is not sticking to lokadalath award. My questions are
(1)Does my father's will has any validity in the court or not?
(2)Do the WILL written by my father prevails Lokadalath award?
(3)What precautions should be taken so that even if my father writes another WILL,then it shouldnot work in the court?

Thank You all....
