Defendant did not file any document with its WS upon which the defendant relied nor mention any thing in whose custody the document is. Whether the plaintiff can object if the document is produced at the later stage? Whether the Court will entertain the document if the defendant produces the document at a later stage?.

In a suit for declaration for coownership of property, a will is annexed with plaint on which basis such declaration is sought. When that will was exhibited, it turns out to be a different will. Though the contents and typesetting of exhibited will are same as that of annexure will but the signatures of all of witnesses are different. The counsel for defendant raised objection and the annexed will was given a mark by the Judge. Now, that the plaintiff evidence has completed and cross examination done in which the witnesses aver that there was only one will and not two in favour of plaintiff, the case is fixed for defendant evidence. Should the defendant file an application for supply of documents i.e. the exhibition of the annexed will or go for application under section 340 Crpc for forgery or any other application/step taken by the defendant.please suggest the right path.

Hi,
There was a property in my mother's name in Bangalore. Unknowingly she signed a GPA in favour of her brother as he also had bought the adjacent property. In June '2000, we had taken a loan from bank against that property without knowing that he had already trnsferred this property to her wifes name. The transfer did not take place in her wife;s name when we went to check with bank officials because of difference in stamp duty . When we came to know of this GPA, we immediately revoked it. As we were in financial stress, we did not follow and fight this matter. In 2010, the bank got awarded this property in decree but again my mothers brothers wife filed for stay and reconsidering the decision. The matter is still under litigation.
What can be the outcome of this case as bank is trying to show in the court that we have joined hands, which is not the case.
Is there a chance of we getting back the property or the excess proceeds if the bank gets the property
What should be our line of action in this case as we just came to know of these developments very recently
Sir,
(i) what is time to provided while issuing notice under section 4 (1) of the PPE Act, 1971? Is it 7 days or 10 days? In some places I have seen as 7 days and in others as 10 days. what is the time provided by railways deptt.
(ii) Similarly what is the time provided for carrying out the order under section 5 (1). In section 5 (2) in some places it is given as 15 days and in some as 30 days. Which is correct in the prespective of railways?
