I have a house property at South Kolkata. Its a three storied building comprising of 3 flats and 4 shops. The resintial flat and shop owners are giving almost 1/20 rent of current market value (current fair rent)of that area. I had requested them verbally to increase the rent but all in vain. 1 of the shop owner (giving rent of Rs.60 - present fair rent is atleast Rs.17000/-)is depositing rent at Rent Controller Office. How should I increase the rent without moving to court? My only income is from bank interest and rent collection from house property.

Dear experts,
Please offer your valuable opinions on the questions stated below.
A suit is filed for a declaration of ownership of the suit property and injunction against demolition by the Pnchayat ( A local authority) on the ground that some of the superstructure on the land in question is an encroachment on the public land ,the suit was filed without serving a statuary notice to the Panchayat ,how ever it was claimed in the suit inter alia that the notice was not required to be given as the action of the Panchayt issuing notice for demolition was illegal and also that the notice was vague as it did not contain the measurement of the alleged encroachment, the suit is dismissed by the court for want of such statuary notice only on preliminary issue decided against the plaintiff
in the circumstances what is the appropriate remedy for the plaintiff?
1 To file a second suit after serving notice?
2.to file an appeal against the dismissal?
3 any other proceeding to be resorted to?
Mentioning of the citations for and against the opinion will be appreciated.
Thanks.

Dear Sir,
We as a delhi based dealer sold some goods to a noida party on 10th June in lieu of a 30 days PDC dated 10th Jul.
The cheque was returned due to "insufficient funds" on 11th Jul then again the same cheque "stopped" on 20th Jul.
We have misplaced the bank memo for "insufficient funds" but we do have a later "stopped payment" memo, however, bank says they will sign the statement in which "insufficient funds" is appearing clearly.
1. Can we file a case under NI 138?
2. Is Our partnership firm has to be registered with Registrar of Firms to pursue the case legally?
3. Since this is out of state sale, we do have the road permit no. that the party sent to receive the goods but do not have the Goods Receipt no., since noida is very close to delhi, the transporters deliver material without GR.
4. On the material receipt note they have just signed without stamp.
5. How strong is our case?
Although, the party has already exported the goods and we know their customer name also.
Please suggest.
Dear Experts,
In a suit on promissory note, the defendant indirectly admitted the execution of promissory note.
Now the suit is posted for Trial.
I have a doubts that who will commence the Trial now, since indirectly the defendant had admitted the execution of promissory note as such the plaintiff is entitled the legal presumption under Sec.118 of NI Act.
So whether the plaintiff or defendant may commence the Trial.
Kindly advise me in this regard....
Thanks and regards.........

Sir/Mam,
1. For example, when an appeal is preferred, U/s 19 of the Family Court Act, why is it termed as MFA and not RFA, even when the appeal is from a final judgement of the family court. I know that the term MFA's are used for appeal from orders on IA, but whey so called when an appeal is from final order, like u/s 19.
