Dear Members,
I was married in May 2004 to a highly educated girl. She was very arrogant and fights every day for small issue me and her parents have supported to her. They started to threat for filling 498a case and blackmailing for money. Initially, I tried a lot to save marriage.
December 2004, she fought me and left my home and started to live with her parent’s house.
She filed 498A with false complaints in May 2005 against me and my parents. We got AB bail from session court then regular bail and trial are still running in lower court till date
I filled divorce case in October 2006 and which was contested by her.
My divorce case was dismissed by lower court in August 2010 then I filled first appeal in high court which is still pending.
After long litigation in court, my wife and her parents got frustrated and requesting for mutual divorce without alimony.
Please suggest how to proceed for withdrawal for 498a case and Mutual consent divorce. I do not have any trust to them.
Should i ask for first withdrawal of 498a then mutual consent divorce?

hello friends. I am facing a peculiar problem. A widow, Madam M passed away some years back intestate. She had two properties, Plot No 1 and Plot no 2, which was taken over by her sons A and son B. There was an oral understanding between the two brothers but nothing in writing.
They did not try and get the Properties mutated in their names. As on date the two plots stand in the name of Madam M.
Son B, who was in possession of Plot 2, passed away recently. Son B, left behind a will and left this Plot no 2, in favour of his son.
The son now wants to sell this Plot No 2 but the problem is that the property, i.e. Plot no 2, is still in the name of the deceased grand mom, i.e. Madam X on the land records.
What should the son do to get this property now mutated in his name? His father though left him plot no 2 in his will, this Plot no 2 was not mutated at the time of his death in his name.
Any suggestions please??
regards, deekhush
I want to know whether a particular person is or was registered as NOTARYT.
Where I can sent RTI application for knowing such details.
the two partners made an partnership deed and entered into an agreement (development agreement)as per the clause mentioned in partnership deed plaintiff have filed the case in arbitration. The clause is like that, if any disputes arises between the contract, both the partners will settled the matter or dispute through arbitration as per the arbitration and conciliation act. But the one partner (plaintiff) is not satisfied with the arbitration proceedings. even the plaintiff wants to complete the contract as per the agreement. And the plaintiff want stay on the suit property till the pending of the suit. so he moved to the civil court for the specific performance. Can he file the suit for Specific Performance in civil court when the clause is mentioned in the agreement that - if any dispute arise between the two parties, the dispute will be solved through the Arbitrator via Arbitration and conciliation act. can he file the suit in civil court. please advise me.

Sir,
A suit for defamation is filed against my aunty for filing a criminal case that dragged on for about 2 and a half years, because of threats from the accused she did not pursue the case and hence the accused was acquitted.
Later nearly a year he filed a suit for defaming him to a tune of 10L.
My aunt did not attend the 2st agjournment hence she was set exparte.
She is not well. In case she does not attend the next adjournment what will happen?
Does Filing a case and not having convicted by the court leads to defamation? pl clarify!

is there any RBI guidline as to recovery of only upto twice the loaned amount and not more?
Sir,
My client's brother (who was a bachelor) died intestate leaving behind 4 brothers. One of the brother is my client. He left some amounts in the Banks and there is no nominee clause.
Normally to release amounts lying in the Banks and financial institutions a case has to be filed before civil court for succession certificate. But I came to know that for all the cases where the amount involved is below 10 lakhs, a separate branch/tribunal is established in the High Court and more than 10 lakhs case has to be filed in civil court. Whether is it correct. Kindly clarify as it is urgent.

Hi Sir,
Is it mandatory to include class-2(father) in legal heir certificate from thasildar when class -1 (wife, son and mother) are alive.
Also if father is included in the legal heir certificate what are the implications. Is he also eligible for an equal share
Nuisance and harassment
sir ,
a person clains to hv given me certain amount of money.but the fact is he hasnt given me any cash and against the cheque amount i have given him cash in return..ie. the deal is closed.now he and his wife is constantly harassing and defaming us everywhere that i am not givin their money back.
there is no documentary evidence with him to prove his claim. On the other hand i have all relevant documents to show that the transaction is closed
1.what can i do if he constantly calls and harass me again & again or defames me?
2.is it not a means to illegally extort money by defaming a reputed person?
