Is it required/necessary to specify the list of proofs in applicaiton?

In written statement all the required proofs were mentioned by the defendant and he is ready to submit when required.

Later an application was made by defendant which doesnt specify or mention of any proofs for that application request. But can defendant show/mention the related proofs during the "argument" session to the honorable judge, for this application, which were mentioned in the written statement?

Or the defendant will need to add amendment to the application, for adding evidence section to show case the proofs during application discussion(argument)?

Thanks.

Evidence act

I purchased material for repairing tenanted
flat. Cash memos issued by the shop were
produced with my affidavit of evidence in court. To prove the cash memos I have to produce the shop keeper who issued it. It was 13 years back and now the shop does not exist and wherabouts of shop keeper is not known.
Witness summons is returned by bailiff with above remarks. Cash memos were issued in my presence and I can testify as to who issued the same. Kindly advise the procedure to prove the cash memos.

Admissibility of satellite photos obtained from google earth

Respected Experts,

Usually, we come across several civil cases where one changes the physical features of property i.e. by making constructions over neighbour's property or over a canal and file a Declaration and/or Injunction suit against the true owner pleading that he had been in possession of property for more than 12 years or so.

In order to prove the physical features existing on the disputed property during particular period, the photographs taken from Google Earth will be so useful.

My queries are :-

Whether Satellite photographs obtained from Google Earth are admissible in evidence or not?

Is there any ruling in that regard?

Pls clarify. Thanks in advance.

Compensation

I had filed a eviction suite against my tenant.
The actual suit was filed by my father who was deceased.
The rent of the tenant is only Rs.60 which he had failed to pay
since 1986.Beside this he has constructed an illegal room which the
learned court had ordered him to demolish which he didn't.The tenant
has a own flat nearby area of my said premises and he let it to other
person. He is not appearing in the court since 2009 and ex-parte
hearing has also been started. Now I want to know is there any
provision to get any compensation by auctioning his household or
by any means to recover my dues, expenses and losses?
