Since the Defendant, being unauthorised occupant of plaitiff's property, has been delaying court proceedings on one or other pretexts, what could be a better course to seek Court's directions under CPC to get monthly mesne profits / compensation for such continuing enjoyment of the property without any rent etc., even though injunction u/O.XXXIX R.1&2 is already in force, in the pending Civil Suit for recovery of possesion; I.A. u/O.XII R.6 for judgement on admission has been getting adjourned for last 26 months, inspite of both the litigants being Senior Citizens

KINDLY ADVICE ON BELOW MENTIONED QUERY;
OUR COMPANY HAS TAKEN ON LEASE A COMMERCIAL UNIT. ACCORDINGLY RENNOVATION WORK STARTED. THE SAID UNIT HAS BEEN PARTED BY PLYWOOD IN THREE SECTIONS TO ACCOMODATE THREE DIFFERENT DEPARTMENTS. BESIDES THIS, CABINS ARE FORMED. NOW B.M.C. ISSUED NOTICE TO STOPPED THE WORK ON THE GROUND 'ERECTION OF CABINS WITH THE HELP OF PLYWOOD' IS AN ILLEGAL ACT AND ONE HAS TO OBTAINED PRIOR PERMISSION FOR THAT.
MY QUERY IS THAT MAKING CABINS OR PARTION BY PLYWOOD IS ILLEGAL AND WHETHER WE REALLY NEED TO TAKE PRIOR APPROVAL FOR ERECTING CABINS & PARTITION.
MEMBERS I WILL BE HIGHLY OBLIGED TO YOU ALL FOR SOLVING MY QUERY.

2nd appeal is pending in madurai high court with my opposite party. Now my opposite party has done illigal transaction on land using illigal WILL. that means he sold to third party...
My district registor is co opeartive with me and asking direction order from high court to cancel that survey number illigal registration and do not proceed with any illigal registration with the survey number until next update from high court.
As per law, opposite party illigal registration is invalid when case is pending.... but we wanted to inform to the parties thru letter who brougt land from my opposite party, becasue we wanted to be very proactive to do this.
Kindly explain in detail like what type is petition we need to do from high court....
If hearing date is next week, can we get order immediate from Judge regarding this.

Hello Experts,
I need your valuable guidance in my below mentioned eventwise query.
1) I had purchased a hut in year 1986 in slum area of mumbai and was iiving there with my wife.
2) In year 1993 my younger brother came from native and started staying with me.
3) After my fathers death I called my mother to mumbai as she was alone in native.
4) My brothers wife also came with my mother so it become impossible for me to accommodate 7 people in that tiny hut and I was also very ill that time.
5) Being a Municipal employee I was aware that sooner or later the slum will go into SRA scheme.
6) I allowed my brother to stay in the same hut and I took a home loan and purchased a flat outside mumbai
7) As stated the hut is being redeloped under SRA scheme and authorities made me eligible in Annexure 2 and agreement also done on my name.
Things were going well but recently my mother passed away and my brother started showing his true colour he in behest of some society members putting pressure on me to give half share in the SRA flat otherwise he will sue me. I have already gave him Rs. 200000/- vide cheques during demolition of hut to find a alternate home which he did but he is become greedy.
Sir, I have all the proofs prior to 1995 and ration card till date so is there any possibility that he can litigate this matter.
I have two married son and one is staying on rent I have not sold the hut thinking their future in mind but my brother has become a source of nuisance for me. Please suggest that he has any rights.

took advise of 2 lawyers one advised to create a new copy of WS and underline amended lines. Other recommended to modify same WS with red strike for deleting a content and sticking paper cheat for new additions.
Which method shall i follow? Thanks.

my maternal uncle transferred(Sold) the entire self acquired property of my grandpa to a third person vide s registered sale deed.
can I go for a declaration that said sale deed does not imply upon our share on the property...and thus we can protect our share
