Filing of revision

Hi,

We have received unfavorable order from the district court in one of the alimony matter, we are thinking to go for revision with High Court, I have couple of questions in this regards.

1. We need to take stay on the order before filing revision or after filing revision?

2. If we again get unfavorable order from high court, can we go for appeal with high court on the matter or we need to approach supreme court?

3. Do we need to appear for argument in case or revision or high court can decide on the matter basis on facts mentioned in the revision application.

Regards,
Nazir

Consumer law

I booked a flat with a builder and paid 50% advance. Builder was to complete the construction and give possession in 1 year. On of the condition of allotment letter was that at the option of allottee, builder shall buy back the flat at market rate or sale the flat in open market and profit shall be shared 50:50, and till then, builder will pay interest. But the Builder neither constructed the flat, not paid the due interest. Customer filed FIR u/s 406/420 in which builder/director obtained bail. My question is whether I can also file case in consumer court. Am I consumer as per C.P. Act. What other civil remedy available for recovery of amount.

Civil suit

I have filed a Civil Suit in the City Civil Court. It is undefended Suit. However, on one date I could not appeared before the Court and now it is dismissed for default. Then-after I have taken out the Notice of Motion for restoration and I have given sufficient causes for the non appearance.
There is no delay in filing NOM as well as for applying certified copy. But unfortunately a bona fide mistake was done by my clerk and wrong dated was typed in the Affidavit of the NOM. Therefore the Court was under impression that there is delay in applying the certified copy of the Oder of dismissal.
Now I want to restore the matter asap.. So My query is What remedy is available to me now?
Should I prefer Review or I should take out 2nd NOM for restoration of 1st NOM as well as main Suit.?
Can i just mention the matter by filing the preceipe so I can pray for restoration of NOM..or 2nd NOM is required??

Plaintiff has past away, does defendant need to inform court?

Unfortunately the Plaintiff has passed away, does Defendant need to inform this to court or this the responsibility of the Plaintiff's lawyer?

Any impact on the case if this is not told by Plaintiff's lawyer to the court ?

Case against irwo

This issue is on behalf of my relative...

1. A Railway flat in Gurgaon was transferred from original allottee with his consent to me on 12-12 2002 by Indian Rly Welfare Orgnisation (IRWO).

2. The registery of the said flat could not be executed by IRWO since the matter was under subjudice with HUDA (HARYANA URBAN DEVELOPMENT AUTHORITY).

3. HUDA was ordered by a court to refund 50% excess amount of land to IRWO in the year 2008 (part amount).

4. Excess amount of 5% of land was reimbursed to original allottees as well transfrees. I was paid Rs.42500/- in 2008.

5. IRWO asked me to return the amount of Rs 42,500 on 31-03-2008 as the original allotee went to supreme court and filed petition. I was not made party at that time of contesting the case. Still I returned the amount of Rs 42500/- on 03-10-2008.

6. Now registry has been executed in my name and I am a legal owner. And HUDA has refunded the balance amount to IRWO. In return IRWO paid the balance amount of Rs.55000/- to orignal allottees after 12 years despite the fact at this stage the are no legal owners. But nothing has been paid to Transferees.

7. At the time of transfer in the year 2002 Original allot-tee executed Power Of Attorney in my favour and submitted affidavit & will that all future transaction would be carried out by transferee (New Allotee).

Now I wish to take up the matter along with all the Railway Flat trasferees jointly, please guide me, whether we can file any writ directly in a supreme or high court or whether a civil suit needs to be proceeded against IRWO.

Thanks,
YP
