Family pension


मैं आपसे पूछना चाहता हूं अगर कोई व्यक्ति सेंट्रल गवर्नमेंट में सर्विस करता है और वहां एक हिंदू है उस व्यक्ति की दो शादियां है सर्विस के दौरान उसके कागजात में उसकी पहली बीवी का नाम दर्ज है उस व्यक्ति ने अपनी पहली बीवी को Ex parte divorce दे दिया रिटायरमेंट होने के पश्चात भी उसके कागजातों में उसकी पहली बीवी का ही नाम था रिटायरमेंट होने के पश्चात उसकी मृत्यु हो गई पर जब फैमिली पेंशन की बारी आई उसमें पाया गया कि पेंशन पेमेंट ऑर्डर में उसकी पहली बीवी का ही नाम दर्ज था जबकि व्यक्ति ने अपनी बीवी को Ex parte divorce दे दिया था तो क्या फैमिली पेंशन की हकदार उसकी पहली पत्नी है जिसका नाम पेंशन पेमेंट ऑर्डर में दर्ज है

Defamation case procedure, fee, time limit

A girl's father given written against me to his police station and mentioned that I molest her daughter when she used to go tuition, over phone, by letter using un-parliamentary language by me and posted her inappropriate photo over social media. But I didn't do that. These all are false allegation against me. I used to go office from my house daily. Since 1 yr ago I was talking to her but after that I've no contact with her. Someone else is doing this and un-necessary I'am involved in this. Police came to my house and abuses me and my family and threaten me not to do this again and leave the city as soon as possible. So request you to please suggest me what to do and how to get out of it. Should I file a defamation case against her father for false allegation. We are reputed family in society. My reputation and my family reputation got vanished because of his false allegation. Everyone talking the same thing. We are living in village area. So you can understand how society works in villages. So request you to please suggest me what to do? How much time it will take to final decision because I'm unmarried, Male. How much fee I've to pay??

Submission of authorisation

Plaintiff (a private limited company) file title suit before the learned 1st class civil judge(junior) for recovery of khas possession and other relief.The evidence of both the parties were concluded and argument on behalf of the defendant (an individual) is going on. at the time of argument defendant raise a point that the person who was signed in plaint was not submit the valid authorization document viz. athorisation letter, copy of resolution etc. which may need to signed by the director, chairman after passing a resolution. Can the plaintiff get the chance to file the same before the learned 1st class civil judge (junior). whether law permit to file the same at this stage when argument already start. please advise me.

Tenant not paying rent and absconding

Hello.

We have rented a residential house by agreement for 11 months, with a condition that agreement will be terminated if tenant does not pay rent or delays rent by more than 10 days.
Tenant has not paid rent and is absconding. He has not paid electricity bills also due to which department has disconnected his connection. when we call him, he does not lift the call. Its happening (not answering calls) for last 1 month.
Can you please advise on procedure..? we are at Bangalore.
Tenant has not been paying rent for last 3 months, inspite of many requests on whatsapp/sms etc.

Op disposed challenged arbitration award

Petitioner has filed OP challenging Arbitrational award in the high court four years back for property finance case. Case listed and Joint compromise memo signed between petitoner and respondent as advised by honourable judge and filed in the high court. Petitioner has failed to honor the joint compromise memo. As per petiotioner advocate update it is a consent order. Is it so ? What is the possibilities to protect petitioner property ?

General power of attorney

I make a general power of attorney duly notarized in the name of my two brothers with the clause sale of properties and to operate bank account in January, 2011. Now I want to revoke the same. what is the procedure to revoke the notarized power of attorney. Is it necessary to publish the revocation of GPOA as public notice in local news paper.
please advise me.

Tenant menance

Respectable Experts,
I have a small shop. I had given the same to a lady for monthly rent. She had enjoyed the same and given rent regularly for 2 years and left the shop to another person without my consent. On enquiry, she has informed me verbally that the person is her staff and she will come again to the shop as she is not well. For the past one year, the person was giving the rent regularly. Now, he is not paying the rent for the past 2 months. The original tenant is not traceable. I am not having any agreement with the present occupier. What is the legal action may be taken against the unauthorised occupant? Any police complaint against the person for unauthorised occupancy may yield any result? Please guide me.

In a suit defendant filed counter claim and while passing the decree the court allowed the plaintiff's prayer partly and counter claim partly. Against the said decree- whether one appeal will lay or two appeals will lay ?

Company and credit society, jurisdiction of court/tribunal

Respected Experts

A director had to pay me money arising from a commercial contract.
Director was the MD of company and held shares and assets in his name jointly with the company.
In due course, director and company secretively sold off their immovable asset to evade making payment to me.
Property was fraudulently sold to a multi-state credit society

Question:
Can a company tribunal exercise jurisdiction to decide the entire sale transaction between company and credit society?
If situation demands and its not possible to cancel the sale, can the company tribunal exercise jurisdiction making the credit society liable for making payment to me?

If not the tribunal who can take a decision for deciding the disputes of all actions of credit society?

Please advise
