Land Grabbing Case

Mr A is the owner of the vacant plot. One evening, when A visits, his vacant property and notices that a shed construction has been started and later when made shifting enquires and comes to know that someone has sold A property to D.
A comes to know that the property has been sold way back before 2 yrs and finds in the mutation records that one Mr Z has made GPA of A and then sold to his family member Mr Y. Then Mr Y has sold to Mr D.
Mr A has filed criminal and civil case against all the frauds.
My query is as follows
When Mr A took the property in 1980 it was for Rs 80,000/- and now when the land grabber Mr z and Mr y has sold it to Mr D in 2006 it is for Rs 10,00,000/-. The suit filed is for the cancellation of the fraudulent Sale deeds and Should Mr A pay the required court fee of 10% of Rs 10,00,000/- for the cancellation and possession of the suit property?

The titles are clear sale deed in the name of the Mr A and when the frauds have made the illegal, bogus documents and created and made mutation in their names in the record of rights but still Mr A has to pay the court fees of 10% of Rs 10,00,000 is it correct ? The layman is not able to pay that much of amount and so is it correct that without payment of the court fees he should not go ahead with the next procedure?
If the frauds do such business then i dont think that the layman would be able to get justice. He would not only be mentally harrassed to see that someone has grabbed his land and when he is unable to pay the court fees, that for his own land he has to pay for his own property , How far is it correct?
so please kindly provide me with the citations that supports Mr A as he is a common man and there is injustice happening in his case.

Can initial vakalat be carried on in appeal stage before the District Judge?

In a suit defendant was defended by his lawyer by virtue of a vakalat. Can the same vakalat be continued to appeal stage by the same advocate retained by the same defendant between the same parties, without having to file fresh vakalat? The initial vakalat stipulate, to act, file appeal, aplication etc..?

suit for damages againast govt.

my house was got damaged due to breakage of a drain situated in front of my house (in public street)due to this breakage water entered & collected in my house resultly it got damaged my house badly.for filing suit for damages against govt. as the drain is operated & built by water supply deptt. Haryana what procedure & provision will apply.plz help

Land Boudaries discrepency


Land Boundaries Discrepancy ;-

A Person - X purchased 1-00 acres land with the boundaries as per the Sale document ;-

Wrong mentioned
Boundaries as per doct. Site Boundaries;
East;- Land of A East:- Land of D
West:_ land of B West:- Land of C
North:- land of C North:- land of B
South Land of D South;- land of A

X is in possession since more than 28 years -from the date of purchase
In fact the land purchased by X is with in the in the same boundaries ,
but the East, West, North & South Pole direction are incorrect on the actual
location and the same are the boundaries -

The Pole directions are only deferring on the site , there is no other change in the
boundaries and Land .The Land is situated in the same Sy number as mentioned
in the Document .
The Same boundaries mentioned in the sale document are either on one side or
the other side .
There was mistake while drafting the sale document- unregistered
by a Village person.
The there is no possibility to get another document from the Vendor,
for the reason that after 28 years possession of X, the Vendor
is trying to deny the sale -
There is no other change in the land .
With the above Site Situation boundaries the Property is located /identified and
in possession of X since 28 years

The Third parties ( other than Vendor ) are trying to interfere with the rights & Possession of
the purchaser

I request the members to clarify on the following and inform ;-

1 Whether the purchaser can successfully maintain a suit for a decree of declaration of Title & Injunction with actual location boundaries against the third parties (not Vendor)
by pleading the mistake in the old unregistered document .

2 Any citations on this aspect my be mentioned

3 I request the valuable suggestions on this issue
