It is general rule that order II R2 does not apply to the execution proceedings. My question is that if the decree holder applies for the one relief only in execution or if claims only a part of total decree,
1)whether his such part application for execution is valid?or
2) only 2nd application for rest of claim is not allowable?
3) both the applications of execution will go irrespective of splitting?
Please cite the case. Thanks

We failed to pay tax to the state revenue deptt.on a large extent of land .the land was taken by the govt as unclaimed land. Now can we claim the land back and claim for patta.please advice

Dear All,
Can anyone pls suggest me any judgement of High court/ Supreme Court in respect of Arbitration matter, wherein section 11(6) is invoked without complying the clauses pertaining to other mechanism of resolution of disputes before invoking arbitration clause?

Hi,
my client is finance co.my client is vehicle finance co.hirer take loan from co.said vehicle on hp is our co,party ready pay installment regularly,then hirer has sold that vehicle to third party,after hirer gone to usa,third party not pay loan amount.co seized that vehicle,third party pay lumsum amount to co. co.has relesed that vehicle to third party,he not pay RTO tax, RTO give notice to finance co.pay RTO tax,who is responsibility for RTO tax, co.and hirer or third party ?

Dear friends,
This is from A. P.state. Can a pattedhar (Owner)gets,share or compensation from a protected tenant when he was given Right on the Land by the Revenue Authorities?
If yes; Further, this came to know to the legal heirs very recently through a will( WILL surfaced recently). Can it be enforced after a lapse of 40 years?

There was a patta of plot given by muncipality by name of sc/st. some time later another patta was issued by same muncipality of same plot to other person. this person sale this plot to a muslim and muslim sale this plot to rajut and now there was a construction on that plot. my quary is that-
1- what siut can be filed in this circumstances?
2- can we filed any criminal complaint/FIR?
3- can we file any suit against muncipality and can we demand another plot?
plz help me.

Respected Experts,
My father (is expired now) sold entire land (ancestral) of a plot to three different parties, when I was minor. Last sale was some 40 years back, and then I was 16 years old. Out of three, two have done construction in full area, but third party’s land is lying vacant. I am only heir of my father and now my age is 56 years. Can I claim the land sold by my father after 40 years? Will I have to fight with all three parties? Does law of adverse possession or law of limitation apply to the vacant land of third party, if I claim?

two pronotes, their is no defendant signature. but over all decree passed against the defendant. but the defendant filed private complaint and get order to proceed to veryfy signature. in this time the plaintiffs got stay against the proceeding from supreme court and continueing the EP proceeding the defendant died by fetal accident. the plaintiffs avoid the signature verification. in this circumstance, can the legal heirs challange the decree of judgemen? if so on by which way to expose the signature verification in legal way and which forum?

I am law graduate and in person contesting my case of service matter but due to certain unavoidable circumstances(CRITICAL ILLNESS)of my parent I will not in position to contest my case which will ready for final disposal in the Hon'ble Tribunal
