Execution petition in High court

Respected Experts,

Can I file an execution petition in the High court for the interim exparte injunction order passed in my favour by the civil court ?

Also can I ask the High court to grant me police assistance under section 151 of the CPC for the execution of the ad-interim exparte injunction order.

As the civil court has denied to execute the exparte injunction order since the prelimanary issue of jurisdiction is pending, since the Defendant has contended that the civil court does not have jurisdiction.

Please guide.

Mutation of property

Dear Sirs,
My mother, in her duly registered Will left a pertion of her house in my favour. Since I was in service ouside, one of my younger brother has kept his household / business goods in that portion. Almost 5 yeras back,i applied for mutation to the Municipality but in the process my brother filed an objection on the ground that he is living there ( He and his family lives in a separate portion transferred to him by mother while alive). The Municipality is not taking any action under influence from the brother. Kindly advise action to 1. Get the mutation and (2) get full possession of my portion. Thanks

How to calculate the compensation u/s 163(A) of MV Act

Dear Learned Experts

How to calculate the compensation u/s 163(A) of MV Act if the age of the deceased is 55 his salary is 16000/month, wife and parents are dead and has 4 children(2 son and 2 daughter both married).

Also explain the procedure of calculation with illustration with given figures...what is the difference between 163(A) and 166 of MV act.

suit for recovery respondents are NRI's having no property in india(disposed off) except bank accounts.
CAN AD INTERIM INJUNCTION CAN BE PASSED AT THE TIME OF SUMMONING (UNDER O38 R5) ATTACHING THOSE ACCOUNTS.

partition deed

partition deed is not registered , it is not watap yadi , can talathi put name in revinew record after 14 yeares with the help of unregistered partition deed

Employer has blocked my salary despite of pending C.P at CAT

Dear Experts,
I have the personal grievance. I am wkg on adhoc basis in an organisation for several years and I have filed the OA in the Hon'ble CAT against the denial of the regular appointment against the vacancy which was created due to the resignation of one employee despite of being empannelled by the selection commitee
The Hon'ble CAT found the irregularities in making the appointment and allowed my application by giving directions to the respondent organisation to consider his case for regular appointment from the date of accural of vacancy with all consequencies with in the period of 3 months from the date of receipt of order

The respondent organisation didin't implemented the order as result I have to file the contempt petition which has already been admitted and issued notices to the respondents


Now the Accounts cell has blocked the salary of my month with the plea that they have not received any communication from higher authorities and tenure of the post has already been expired which was upto June 2010
When I stated that why they have released the salary for the month of July 2010 before I filed the Contempt petition. In return they have said that they have relaesed it by mistake

Now I have the following queries

1 When I have already filed the Contempt petition before the Hon'ble Court. Whether I should have to file the seaparte application before the Hon'ble tribunal to prove that act of the respondent was delibrate and willfully so that court can take the contempt proceedings against them?

2 Whether employer can block the salary of the employee under such circumstances?

3 Whether I should have to made the Accounts cell as separatae party?

4 Any other remedy you can suggest that will be most welcome?

Importance of Registration of Temple Trust in Village

we the villagers of Makhjan in Ratnagiri District having our worship temple since 1982 and we are operating it through our Mandal through its member but still today we have neither Registered our Temple Trust nor its Mandal before the Charity Commissioner. Can i get me know what are the importance of Registration of Temple Trust and its Mandal, What benefits we would get after its Registration and whether it is essential or not.
