If the application u/s 27 of the act can be proceeded ex-parte and what will be the procedure?

KINDLY NOTE THAT APPLICATION UNDER SEC.27 OF CONSUMER PROTECTION ACT IS FILED FOR THE EXECUTION OF JUDGEMENT PASSED BY THE SAID COURT.PARTIES WILL BE SAME AS IN THE CASE. NOTICE WILL BE ISSUED TO OTHER SIDE AND IN CASE NO ONE APPEARS THEN YOU CAN FILE AN APPLICATION FOR WARRANT FOR ARRESTING THE RESPONDENT FOR THE RECOVERY OF JUDGEMENT AMOUNT. GOOD LUCK.

Yes, it can be proceeded with ex parte. The application will have to mention the details of the person upon whom the attachment or arrest order is to be issued. The application will have to be supported by affidavit.

It can be proceeded exparte. Such a decision can be made only by the Forum/Commission.
