Corporate Group Mediclaim Policy

Fact : In one Pvt. Ltd co. had Group Mediclaim Policy due for renewal on 5th Oct,2010. But due to oversight co. couldn't able to renew it. In meantime co. got qoutation from another insurance co. which is very low compared to original renewal premium of old policy. After that Management decided to take GMP from new vendor, but by that time 23 days passed. During this 23 days time 3 employees mediclaim come. There is no terms regarding GMP in offer letter. Just company has announced that whoever completed one year will be eligible for GMP. GMP also just before one year only started.
My Querries are:
1). Can employee claim from Company for his claim?
2). Can Company liable for employees cliam?
3). Is there any possibility of legal case?
4). If company is ready to give some token of help than what should company has to get something in writing from employee. like ... employee can give in writing that I recd. so & so amt. and now I have no further claim against this issue in future. (I want some write up in legal point of view.)

Eligibility to become a Patent Agent

Dear Sir,

I am an Arts background student, working in a IP law firm. Is there any way to sit for the Patent Agent exam ? If I acquire a degree in Cyber Law, will it make me eligible to sit for the exam ? Please guide me to shape my future career. I am interested to be in this profession.

maharashtra nursing home act

My query is: why nursing homes are considered in the category of industry and charged electricity, water etc. at those rates?

Government considers medical establishments as hospitals established by government or trusts.

But majority of medical service is given by small establishments owned by single doctor. These are consulting rooms, small nursing homes (10 to 30 beds ), laboratories, diagnostic services.

Small individual setups are not given proper thought.

1. They are owned and managed by a single doctor.

2. This doctor works for 24 hours.

3. The trained staff (nurses, OT assistants, x-ray assistant ) is not available. He trains local persons of 9th,10th, standard. These people vanish suddenly. Doctor has to train new people again. This story repeats again and again.

4. So the doctor has to work single handed and take all stress, risks and blames.

5. He works without any financial security, retirement benefits and security.

6. More than 90% of medical service is given by these small set ups.

7. There is no clear reference about category of these small setups-residential/public/commercial/industrial/agriculture. These small setups are allowed in residential areas. But they are charged as commercial setups.

So he has to purchase infra structure at commercial cost, raise loan at commercial rates and pay taxes and services (water, electricity) commercially. This significantly increases their infrastructural and maintenance cost.

This increases and jeopardizes the cost of the medical setup and cost to patient.

8. Bigger hospitals are categorized as public setups. Bigger hospitals are benefited by low cost land, subsidy, tax benefits, associated nursing colleges/medical colleges etc.

THESE SMALL SETUPS SHOULD BE CONSIDERED AS RESIDENTIAL UNITS.

companies act., 1956

our client company was incorporated in the year 1985 and they want a certified copy of incorporation certificate from roc office. but the said certificate of incorporation is not avilable in the records of the roc office either physcially at their office at manesar or at electronic register on the portel. the problem is to how to get the certified copy of the said certificate from roc office.
