My client’s mother had got notice from one nationalized bank that My client’s mother was given guarantee to Mrs X’s term loan and after getting such notice my client and his family shocked and found that the original land document ( Sale Deed) was not in home, his younger brother confess that he has given the said document to Mrs X husband just for study the deed but Mr X & Mrs X without my client’s brtother’s consent given the said document to Bank as mortgage, after filling the RTI against Bank, the bank has send photocopy of one affidavit and Mortgage documents, as my client’s mother is illiterate so she just can put thumb impression and from the photo copy its not clear that photo attach with the affidavit and the thumb impression too.
My client is sure that his mother neither had given any thumb impression nor given any photo to the bank as she is suffering from illness and always kept lying on bed since 10-15 years.
Now my clients wants to get back there Land document to their own custody and he also want that his brother also become safe.
I need the suggestion what steps should I take on behalf of my client so that I can help them to get justice.

Hi
i would be travelling to UK for an official visit after 25 days.In the visa form,if i select married,it needs to be supportted by marriage certificate.but till now i have not got my marriage certiifcate .pl advise in this case what should i submit since i dont have any document supporting my marriage

Hi,
I am trying to fill form1A for company registration which i downloaded from the MCA website. The problem is that I can
fill up the whole form but can't sign the document. when I click the Signature field given in the form, nothing happens.
i.e. I can't attach my digital signature to it. Please help if anyone has encountered this problem before. I need it very urgently. Thanks.

Hi all
This is happened to my frnd he is not understanding what to do..pls hep...he completed his CSE in 2009..by looking in to paper add, he joined in firm(where the firm stated in paper.. that salary is 16000pm in 1st year and 2nd year 20000pm)now they are not paying any salary to him and what they are saying is they will assist in placements and if one selected in placements then only they will pay the said amount...As per agreement if the guy left after the period of 4 months after training period he has to pay 100000/-for violation of agreement..till now they didnt assisted any placements...can there be any pre employement bond like this...if he left that firm will they sucessed legally... pls help on this

my client is having a registered trust governed by Indian trust act.all the trustees except one are family members. Now they are interested in converting it to fully charitable trust dedicated to computer literacy purposes. Can you pl. advise as to what changes in the deed shall be required to change the objective of the trust? will it affect the date of formation of the existing trust? further advise as to what should be done to give the trust national validity?

There is one case filed against me last year on august 22nd 2010 that i have sent obscene sms to a gentleman(who is a known person to me) from the website way2sms.com. i was arrested on 22nd evening and on 23rd morning at 10 i was released on bail. case is registered under the section U/s 292 of IPC. recently police have filed charge sheet saying that they did not get information from my mobile operator airtel which suggests that i have sent any sms to any one(leaving apart obscenity). infact i did not sent any sms to any one in obscene manner. the person who raised complaint against me is a known person to me right from my childhood and he vows some money to me. I did not get that from him and in anger i shouted on him.
now that charge is filed saying that there is material or evidence available which suggests that i have sent any sms to any one. some one has given me suggestion to apply for quashing of case in high court as it is waste of time going and attending to court for every schedule.
can you suggest me if quashing of the case is the most appropriate thing for this. as this is almost 1 year old case, judge is not paying enough attention.every time my case arguments get postponed to next month.till now i took leave 6 times in my office to attend to court.
Can we apply for quashing for this case ?
Can we succeed by appyling to quash the case ?
if so how much will it cost ?
how many days/months/years will it take ?
Do we have to attend to court during the time of quashing ?
Can you please help me out with all the above.I will be very thankful to you.

Hindu succesion act 1956, Posession of husband's property
My sisters husband He had married my sister by G.J.Mandir name,who was serving in P& T Departmentby name Babulal.J. Mandir. He died in 1983, He possesed One plot in P& T cooprative housing society, One building on his namewas according to revenue and Municipal records G.J. Mandir,and one plot. Out of these the plot in P& T. society alloted to him on the name which he was serving with P.& T depart ment ie. Babulal J. Mandir. In P& T Department he had done the nomination of my sister.
My sister had filed an application with the district court to preserve her succesion rights and stop her inlaws withdrawing the service and other benifits from P.& T depart maent till 1986 the case remained without any decision After a specialCivil application in 1986 to gujarat Highcourt and according to its rulling the district court ordered the P& T depart ment that The status qo order doesnot apply to N.B. Mandir the wife of B.J.Mandirie.The said G.J.Mandir. The P.& T depart ment was also ordered to pay allthe dues and benifits leagally to be given to Nitaben B. Mandir.After getting service , the legal aid stopped or the pleader lady who was un married on her marraige might have shifted to other town the case remained un attended and in Feb 2008 it was disposed off by the district court as exparty decision due to absence of applicant.
At the timeof filing the case the P.& T. Society was served a notice and after District courts ruling society was represented by my sister to let her take the possesion of her inherited property in written as well as orally attending the generalbody meeting, they have been repeated ly asked to aloow her to aveil her inherited rights on the said plot. In One of the reply they have demanded for the allotment letter as well as share cerificates. means the allot mant has taken place. Now on one or another reason they are not allowing her to take possesion of her inherited property.They( The society president and others) are asking her to get probet and then to come for possesion. on other way they are sending messages you are not entitled for the inhetitance to the plot but you come and sign you will be paid some amount.
She has re married in 1990.
According to Hindusuccesion law and supremecourts judgment in the case of CherotiBharti Appeal civil 1323 0f 2008 judgment date15/2/2008
The supremecourt ,s bench has held that even after remarraige the widow does not loos her right to her inherited property from her husband's property.
Should she goand start to take possesion of the inherited plot and if any one tries to stop her ask the police protection, or in advance she should ask police protection to avoid any ones ilegal distabunce?, Or first she sholud restore the case in the district court and then after final decision she should try for the possesion?
