Loan from Nationalised Bank

I wish to construct my house on my plot of 200 sq. yards.
plot is in situated at Sehakari Samiti, which is not approved by the Ghaziabad Development Authority. i tried to get the loan from Nationalised banks but they refused saying that they only sanctioned the loan to area approved by Concerned Development Authority.

kindly advice how i can get the loan?

Can a writ petition be filed in Supre Court against SIC decision under RTI Act

This refers to section 23 of RTI Act 2005, which reads "No court shall entertain any suit, application or other proceeding in respect of any order made under this Act and no such order shall be called in question otherwise than by way of an appeal under this Act."
In view of this, my questions are
(1) can I file writ petition directly with Supreme Court instead of High Court ?
(2) Can I challenge decision of HC in Suprement Court ?and
(3) what is difference in appeal & writ-petition ?

legal requirements for registration of trusts formed for welfare of employees

can anyone guide me through the procedure for registration of trust/fund formed for welfare of the employees? are there any special requirements to be taken into consideration as far as the Income tax Act and BPT Act is concerned? do provide a list of documents to be submitted to the charity commissioner along with a copy of trust deed if possible.

Jurisdiction of consumer forum in Indian Railway Matters

Dear Sir/ Madam,
We have consumer protection case against Indian railway. We are pursuing same since 1984. This is regarding bad service and negligence. District court granted Rs. 72000/- (ie Rs. 1000/- per passenger) in 1986 and interest @18% from the date of judgement. Indian railways informed district forum that it has no jurisdiction as railways have got their own tribunal. Finally National forum gave decision that consumer forum has the jurisdiction but the case may be heard in front of State forum instead of district forum. State forum again kept the same compensation as decided by District forum.

In 2003 Indian railway has filled a writ petition in High court hiding judgment given by National Forum which has not come on board till today.
First of all I could not understand how a writ can be admitted in this case.

Since this writ is pending state forum is not proceeding with our application for execution. Kindly guide.

Green Card question

My entire family with US citizenship and OCI status moved back from the US 1.5 years ago. My wife received her green card 1 year before we left the US. Before departing, we obtained a work permit for her which allowed her to stay outside the US for 2 years which is expiring on Jan 2011. She can travel to the US once before that to keep her green card status active, but then what after that since her green card is valid only for 3 years? Is there any long term solution to this problem or does it mean she will have to keep making a trip to the US once every year to keep her status active? Can't we apply for a US citizenship for her since she's married to a US citizen who is now living in his country of birth due to the nature of his work and also has children who are US citizens as well?

Residential premises for commercial use

Hello!,
I am planning to buy a residential premises in ground floor of a building that is under the provisions of Maharashtra Apartment Ownership Act 1970.

Can I use this premises for commercial purpose (Clinic)?

The committee members are of the view that they will not provide any written permission for the commercial use but will also not oppose for the same.

A couple who are senior citizens, wish to make a will.They have a few self acquired properties whom they wish to will, in favour of their son, to the exclusion of their 2 married daughters. The daughters have no objection to it. However, the couple wants to stipulate a condition that the son after their death and also when the property is transferred to his name, should not sell, mortgage the said properties lest the will is not valid. Is such a condition valid and can it be enforced, if so how ? What are the other options?

Res. Sirs,

Last night employees of power department fell down all my growing bamboos standing backyard, citing the reasons as hindrance to the poll wiring; whereas, there was no any hindrance to the poll wiring by the bamboos.The felling down took place at night . Please suggest remedies, if any.

On my personal front I undertook a survey and studied the performance of this wonderful site which must be ranked as one amongst the best the world. I share my study details in brief for the information of the promoters of the site.

1. Almost all the links of this site are visited by every login user.

2. Forum, News, Articles, Notifications, Experts are the most popular links in the site as patronage is extended to the maximum.

3. Out of the 1000 experts listed in the Hall of Fame only 10 to 20 members are actively involved productively to add professional values of the section. Of which, only 3 to 5 experts contribute their opinion with substance. Rest of them either concur with the opinion already offered or involve in personal comments against our own learned community.

4. Technical Performance of the site is of the highest order without any break down or server issues. However we can enhance it further when we undergo some changes in the design and fine tuning of queries in the computer programs.

5. There are still adequate scope for Information System security issues.

6. New dedicated links like Debates, Alumini Club, etc can be introduced. This would further enhance the scope of popularity of the site.

7. Dormant links like Communities, Jobs, Polls, etc can be redesigned to invoke more participation by the visitors.

Though this information is already shared with the ADMN of the site, I want experts to expand the scope of my above study to make this site embossed with unique class of its own for the benefit of the law deprived public at large.
