Reservation to Persons with disabilities in employment-Service Matter.

There is provision for reservation (not less than 3 percent) in govt. employment to persons with disabilities in terms of Persons with disabilities Act, 1995 and Office Memorandum issued in the December, 2005 and in the year 1996 (available on the official website of the Chief Commissioner for persons with disabilities). Most of the departments are not implementing the provisions in this regard and interpreting the Act and OMs differently.

I need clarification whether a person with disability, who is selected for a post on his own merit (without relaxed standard)can be denied the benefits admissible to persons with disabilities. Will such candidate be treated as 'General Candidate' for placement in seniority list and promotion purpose?

Kindly clarify and provide the rules/court order/s in this regard.

Loan Recovery Harassment

Hi, my father had taken a loan for 1.5lacs from a local patpedhi bank. The owner of the bank was a friend of his and asked my father for a decoration job to be done for an opening of a new branch for which he said that in return of the job which estimated around 2lacs he would waive off the loan and my father did the same. My father then passed away after a few years in 2003. Now for the last couple of years the bank recovery agents have started to send notices sayng tht we owe them money and are asking us to pay up which they say has reached 4.5lacs or else they would seal our house which after my fathers death has to been transferred to my mothers name, also the owner of the bank refuses to talk to us now and also the bank wont show us the loan documents as we dont have any. I would appreciate if you could advise what should we do about it.

conditions for filing partition suit

My mother died intestate leaving behind self acquired property i.e land and building. We are 6 children to our mother. Out of 6 children 4 are dead against selling the property. One of the son is staying in ground floor of the property. upper floor is totally empty. They will never sell that property and I want my share to be sold so that I can use that money for my life. I am a retired person. Can I file a partition suit ? The house cannot be divided into 6 parts. What is the procedure and condition for partition suit filing or is there any alternative as reconcilliation is impossible.
