Dear Experts,
my client has issued a blank undated cheque for Rs.100000/- and he had paid the entire amount along with interest and got receipt without mentioning the purpose. After that my client insisted to return the cheque but the holder gave reply that it was misplaced and so my client had made stop payment in the month of Oct, 2010. Now on 17th jan, 2011 a third party (sister of the holder) has presented the said cheque claiming an amount of Rs.5,00,000/-. Pls give suggestions. Can i initiate any criminal proceedings against the both, if so under what section. Pls also provide any valid point to reply the 138 notice. and further what meant by holder in due course.

MY CLIENT HAS NOT ISSUE ME ANY NOTICE REGARDING THE STOP PAYMENT. IN THE BANK TRANSACTION SLIP IT HAS BEEN MENTIONED THAT " CHEQUE DISHONOURED AND RETURNED FOR THE REASON , PAYMENT STOPPED BY DRAWER.
NOW SHALL I PROCEED FOR LEGAL ACTION AGAINST HIM. KINDLY GUIDE ME.

BASICS OF SUPREME COURT OF INDIA
1. I WOULD LIKE TO bring to the notice of all indians about the functioning of szuprme e court of india from my view.
If someone wants to file an appeal against the order of high court in the supreme court of india please follow these simple procedures.
1. engage an advocate who is honest reliable
how to find out honest and reliable
if he says only the positive points favoring your case . so he is trying to extact money by giving solid assurance
2. make consultation in lawyers clubindia you will find honest and good lawyers who will provide good advice like mr ajay bansal, etc. etc.
3. within 60 days of high court order you have to file an appeal in s.c.
make sure you make suffieient number of copy of petition to be filed in supreme court. if there are two respondents make three copues of the paper book.
4 the day your slp is filed within 15 days of filing the same your case is listed for hearintg on monday or thursday defnitely. the case is listed as per the category and rder of listing . get a copy of supreme court procedures availabale in internet and reception counter for rs. 20/-
5. when the matter is listed and notice is issued. try to serve on the respondents by yourself with acknowledgment immy. from your side the supreme court will send the notice directly also.tgell your advocate to file the process fee and spare copies of the slp in the court immy the court order issue notice so that the notice is sent immy.
6. since you have some spare copies already prepared try to service the same.
since huge matters are pending due to non service. if service is not complete the same will be listed before the ld registrar court and only after service is complete the sazme is ready to be listed before the court.
so make sure service to respondents is a must,
file the acknowledgement in the filing cournter and abty filing application for filing proof of service.
7 once the service is complete and advocates are engaged by respondents. type out in a paper the name of respondents and advocates engaged by them simply file it as a letter in the filing counter.
8 all dealing dealing assistants in supreme court of india are very polite and helpful. meet them on any wednesday normally wednesday they are littlew free.
9 if the court order issue notice and stay the counsel has to file process fee immmy sos that stay order is despatched immy. since anyorder is to be issued directly on the same day itself even the dealing assistant has to stay till late night he will issue the same only them he can have his dinner. it is mandatory.
10. so dont believe on the works of any touts or anyone you dont need to worry for anything you are in the safe hands I assure you and guarantee that no harassment, no trouble shooting you will face no problem.
