Dear Sir,
As must be knowing i had query and you cleared my some of the doubts. Coming to the one more, case fact.
My mother who retired has filed case in Karntaka Tribunal Administrative (KAT) in the year 2006, and the advocate has given the case number 5879/2006 but still she has not got any updates about that case. I just tried KAT Website to check the status of case, but not able to find it. What would be the next proceedure please do clarifiy and clear the doubts.

A person was appointed at the post of lecturer and was subsequently his appointmnet was cancelled. he filed a writ petition in the high court. stay on removal was granted and he was allowed to continue in service. writ petition is still pending. but the salary he is getting is as per the 5th pay commission and the college is not granting him salary as per 6th pay commission. what can he do.is his claim for salary as per 6th pay commission is correct?

We remember that levy of service tax on ‘Rent’ was held ultra vires by Delhi High Court in case of Home Solution Retail India Ltd. Vs. UOI and others (2009) 20 STT 129. Union of India- who was the respondent in said judgment filed a SLP in Supreme Court, praying inter alia for stay of operation of Delhi High Court judgment. However, the Supreme Court did not stay the operation of Delhi High Court judgment, but issued notices to parties concerned to file their replies. During pendency of matter in Supreme Court, Revenue authorities instructed their field officers by way of Instructions dated 15thJuly 2009 to take necessary action to safeguard revenue by either pursuing the tax payer to pay up the service tax or resort to means under law. The Instructions issued on 15 July 2009 were challenged by SSIPL Retail Ltd. in a Writ petition filed before Delhi High Court who has taken strong objection to said Instructions and it was assured by Additional Solicitor General, appearing on behalf of the Union of India, that corrective steps will be taken to issue further instruction, in super session of earlier instructions, to not to demand service tax till such time Supreme Court decides the SLP.
We want one clarification that if it is applicable on the properties situated in other states.

Mr Ranjit nad rani got married on 1/4/75 as per hindu rights and customs But Mrs ranjit approached to District court, aurangabad for divorce in 79 and obtained Decree, Ms. Rani remained unmarried. in jan 81 Mr. Ranjit came to know that Ms Rani gave birth to a female child named Ranjitha.
Some time later Mr. Ranjit got married to one Madhuri and was leaving a happy life with two children Bunty and Bubly
During Financial Year 06-07 Mr. Ranjit filed an income tax return where in he has shown a family property consisting of a resendital property where he is leacing noew and a commercial complex located at Nirala Bazar, Aurangabad worth 5 crores. this property was inherited form his father.
Ms. Ranjitha got maried to mr. yusuf who is medical doctor. Ms ranjitha sent a legal notice on jan 1 07 claiming a share in Hindu Family property in capacity of Daughter.
Mr Ranjit denied that Ms Ranjitha was born to him. The Family court aurangabad directed for the DNA test for both the parties. but mr ranjit refused to undergo the same. then family court held that mrs ranjitha is a legitimate daughter of Mr Ranjit.
Aggregieved by diposal order of the family court, Mr Ranjit challenged this order before Hon'ble High court of Bombay, Bench at aurangabad.

1. What is the legal remedy, if you approach a lawyer and submit your case with full trust on him, but he ultimately sits on your case file and doesn't even filed the case? Ultimately, whenever you approach him, he says that he was busy and he would very shortly do the same. It happened with me in one of the case of YO BYKE when repeatedly when I approached the lawyer, he would very nicely and politely speak to me with this excuse till the time I could with great difficulty withdraw the case from him and submitted to another lawyer. This ultimately delayed filing of my case by couple of months. Similarly, the other lawyer also started delaying the case till I influenced him to a local friend of mine. In yet another case of verification of land papers, another lawyer sat over my case for good about four months and similar polite replies were given til he finally did my job. Despite having received the payment in advance. Ideally the rele verification of land papers should not take such so much time
