House poseession

Namaste
i have one query..plz help me

1. My Details -
Name - Bitan Arya/Female/45/Married, lives in Sitapur (UP)

2. Problem_My brother purchase a residential plot in 1989 in sitapur, after my marriage my husband's economical condition are not good, so my brother gave to permission of construction on above said land and said stay on that home on behalf of mutual consent.

3. my husband constructed two floor building. and me, my husband & my kids lived in that home from 1991 to till date WHICH WAS OWNED BY MY BROTHERS (only land/all construction done by my husbands income).

4. NOW IN 2017 my brother said (owner) "STAY OUT OF MY PROPERTY" i agree but we want at least 2 or 3 year time to possess out of that home due to poor condition & daughter marriage in process.

5. From your part (Court) we need legal order (time) to move out from that house...HOW

What is structural changes to flat

I am planning to extend the window of my kitchen; Change the sink location and slightly increase the entrance of the kitchen. I am residing in Mumbai. Will these constitute structural changes to flat. My society's secretary had told not to make any structural changes in the flat.

Registration and stamp duty

I have made an agreement for land from builder. All the money given is white (by cheque and account transfer). Now builder says i can go for registration either by government guidance valve or any value upto maximum actual purchase value.Please suggest what i should do.

A)What if i get registered with guidance value?
1.Is there any legal problem?

2. What will happen if i sell the property after 10 years and i take money everything in white and pay tax to government?

3. Can i avail capital gain tax benefit?

B) Any problem/disadvantage if i register with actual purchase value?

Co-op society - max leviable premium for transfer of flat

What are the maximum rates of Premium that can be charged for transfer of flat in a co-operative society in Maharashtra?

I can find 3rd party websites providing this information (for example - http://maharashtrahousingandbuildinglaws.com/maximum-rates-of-premium-for-transfer-of-flatspremises/), but I would like to avail of the official document.

Gift of unregistered property

My father, mother and I jointly bought a row house in 2000. Stamp duty was paid but the agreement was not registered. The previous owner and the 1st owner had also not registered their agreements which date back to 1995 and 1985 respectively though stamp duties have been paid.
My mother passed away in 2009 and the society has transferred her share to my father and me as sole legal heirs. My father and I now own 50% each.
My father wants to gift me his 50% share but the registrar is not willing to register the gift deed. He says that our purchase agreement and the previous agreements are not registered and the society has not received conveyance yet.
Please advise how I can register the gift deed.

Transfer of property

My mother is 88 years old.She has 3 sons and no daughter. She owns a flat in a registered CHS. She had nominated one of her grandsons for the above mentioned flat.She has, also,made WILL in which she had stated that after her demise all the 3 sons will have equal share in the Flat.As she is bedridden her WILL could not be registered but notarized with notary coming to our residence and in his presence she signed the WILL and made entry into his register. The entire procedure was completed in presence of a lawyer who is also the Executor for the WILL.Now we want to know, in the event of her death, how do we go about so that the flat is transferred on the names of 3 sons. Please advise.

Change of property name

Sir my grandfather gave a gift deed to my father and after 16 yrs my father expired and recently before 6 months my grandfather also expired.Now how can we change the property name,bills name,property tax names to my mother's name.Can you please explain the procedure.

Power of attorney revocation

I'm a tenant renting a shoproom. In 2007,landlady made agreement with a promoter for development of the property.All the tenants were offered option for outright purchase at cost price, which we accepted.But after prolonged delay, landlady has revoked the power of attorney given to promoter.Now landlady wants us to complete remaining jobs out of our unpaid contribution and she wants to register our portions to us bypassing promoter.As per joint venture agreement, all existing tenants are within landlady'd allocation.Can the promoter get an injunction from court against these registrations - either for those within landlady's allocation or for those within promoter's allocation/

PARTITION UDER PUNJAB REVENUE ACT

Some persons who did not have clear titles in jamabandi filed partition case against me and made me ex parte in said case and took share in my land which was khana khasht. Now the partition has been canceled by my appeal. Can I file case case against them under IPC 209 and do I have any other remedy against them?
