I booked a studio apartment in Elvedor from Imperia Wishfeild Pvt.Ltd in Sector 37c Gurgaon on September 2012.Builder did not start the project till mid 2016.On refusal for refund of booking amount I filed case in consumer court Gurgaon .Now in argument stage builder claim Studio Apartments are only for Hotel rooms. So it is commercial property. Hence consumer court has jurisdiction to take case this case. Case be dismissed.
Whereas we claimed it is dual use property. Can be used for both residential n commercial.
Now can you guide me how to prove that it is not purely commercial property?
Or any previous case reference where consumer court took case for studio apartment n court asked the builder to refund the money.

Hi Sir,
My name is Ajinkya and I booked a 1BHK flat in Pune. We asked a builder for an agreement and sale deal. He saying that He will make sale deed in the name of society and not by my name. When society has formed I will be a shareholder of it. He is also not going to register the flat under that government rule of registration act. Is this safe? Please, sir, help me.
P.S. its a new bulding and ready possession.

CONSENT TERMS WERE MADE AND IT BECOMES DECREE IN HIGH COURT.
If we, Ramesh Ramdeo Gupta & Three others as Defendants No.1,2,3,4 had given the right to Smt. Ramrati Widow of Radheshyam Gupta as Plaintiff Devendra Radheshyam Gupta Defendant No. 5 and Mahendra Radheshyam Gupta Defendant No.6.
If Plaintiff Expired and Defendant No.1 is also expired and the given Rights were not Executed in 17 years by the Rights holder i.e. Defendant No. 5 & 6.
Now my Query is, IF RIGHTS WERE NOT EXECUTED FOR 17 YEARS, CAN DEFENDANTS NO. 5 & 6 CAN EXECUTE IT NOW?

I am looking for a legal opinion on my rights over my mother’s self acquired property.
We are two daughters and one son for our parents and all married. Our mother expired on 05.06.1996 leaving a house, self acquired property in her name without any partition or testamentary partition among us. Our father expired during 2012 leaving nothing. Now our only brother occupying our mother’s house stating that it is only for me being a male son. Shall we approach appropriate Court to get our portion.

What is Hiba? After receiving the share amount in the property shall I get Hiba Release deed in writing from the co owner?

I have purchased a plot in BBMP limits ,Bangalore which has DC conversion for the complete land and has NOC from BDA. and the developer has paid the betterment charges upto 2014.The layout is formed in 2014.Can I get 'A " khatha for my individual plot.

I have purchased a duplex house in Bhopal by a builder and sale deed of incomplete house was registered by builder in my favour on 27- 11- 12. In sale deed , plot area was mentioned as 840. 14 sq.feet.Now house is complete and ready for possession and builder is demanding last instalment and cost of extra land 51. 21 sq.feet@Rs.1, 200/- per square feet i.e.Rs.61, 258/- before possession.Is demand of builder is legal and should I pay this amount to him for taking possession of house?

Right to husband's property after his death
My husband died without a will. We jointly held immoveable properties which were self acquired. Also there are some moveable properties like shares for which no nomination was made. I have received amounts from insurance and employment settlements as a nominee. I believe as per Hindu succession ( we are Hindus) me , my minor daughter and my mother in law are the only legal heirs to his properties. What documents should I get prepared like succession certificate or the letter of admiNistration ,which gives me absolute ownership and rights to his share of properties and other properties held by him.
