Pwd road and nala on my agri land.

Dear sir,
In my village waiser pwd road is passing along with my 2 acre agri land. The road was 16 feet broad and now pwd is constructing 24 feet broad. Pwd has 66 feet road broad space in revenue record.so along with my agri land pwd dep. constructing road in my malkiyat (ownership) 2 to 10 feet. The road is not on its own position. They are measuring the road from centre of road instead of burji pathar.
How i can stop them to use my agri land to make road legally.
They have to measure the road sides from burji pathar or not.
Please help me

5. Devendra Radheshyam Gupta,

CONSENT TERMS

1. The Defendants waive service of Writ of Summons.

2. Defendants admit that the properties described in Ex ‘A’ to the plaint were the property of Hindu Undivided Family consisting of plaintiffs and defendants.

3. Defendants (1) Ramesh Ramdeo Gupta, (2) Rajendra Ramdeo Gupta, (3) Pushpa Ramdeo Gupta, (4) Kamla Ramdeo Gupta, admits that under an Agreement of Family Settlement dated 1.10.1998 at Ex ‘D’ to the plaint, defendants (1) Ramesh Ramdeo Gupta, (2) Rajendra Ramdeo Gupta, (3) Pushpa Ramdeo Gupta, (4) Kamla Ramdeo Gupta received from the plaintiff and defendants (5) Devendra Radheshyam Gupta, (6) Mahendra Radheshyam Gupta a sum of Rs.75,000/-(Rupees Seventy Five Thousands only) by cheque no. 434494 dated 25-1-1999 and another sum of Rs.75,000/-(Rupees Seventy Five Thousands only) by cheque no. 434495 dated 2-2-1999 drawn on Shramik Sahakari Bank Ltd., Sakinaka, Mumbai branch totaling to Rs.1,50,000/- (Rupees One Lakh Fifty Thousand only) in full and final payments of the value of their share in the property mentioned at Ex ‘A’ to the plaint and in consideration therof they have relinquished, released and surrendered all their right Title and interest therein in favour of the plaintiff and defendants (5) Devendra Radheshyam Gupta, (6) Mahendra Radheshyam Gupta. Defendants admit the correctness of the contents of the said Agreement of Family Settlement at Ex ‘D’ to the plaint. Defendants further admit that they have duly signed the said Agreement at Ex ‘D’ to the plaint after being read over the same to them in Hindi language. Defendants (1) Ramesh Ramdeo Gupta, (2) Rajendra Ramdeo Gupta, (3) Pushpa Ramdeo Gupta, (4) Kamla Ramdeo Gupta, admits that they have now no right title and interest of any nature whatsoever in the said property described in Ex ‘A’ to the Plaint.

4. Defendants (1) Ramesh Ramdeo Gupta, (2) Rajendra Ramdeo Gupta, (3) Pushpa Ramdeo Gupta, (4) Kamla Ramdeo Gupta, agree and undertake that they will neither interfere with the management of the said property by the plaintiff and defendants (5) Devendra Radheshyam Gupta, (6) Mahendra Radheshyam Gupta as exclusive owner thereof, nor shall they interfere in getting the said property transferred in the name of plaintiff And defendants (5) Devendra Radheshyam Gupta, (6) Mahendra Radheshyam Gupta.

5. Decree in terms of Consent Terms.

6. No order as to cost.


CONSENT TERMS WERE MADE AND IT BECOMES DECREE IN HIGH COURT.

If Plaintiff Expired and Defendant No.1 is also expired and the given Rights were not Executed in 17 years by the Rights holder i.e. Defendant No. 5 & 6.

Now my Query is, IF RIGHTS WERE NOT EXECUTED FOR 17 YEARS, CAN IT IS POSSIBLE BY DEFENDANTS NO. 5 & 6 TO EXECUTE IT NOW?

Pagdi property in south mumbai

Hello,
My father has a pagdi property in South Mumbai under his proprietor firms name and paying rent from last 16 years. He keeps his business materials in this property. He has expired. His will mentions that this property should be inherited to his daughter i.e. me. However the landowner says that since my father is dead, this property is his and is not willing to transfer the name on rent receipts and also not ready to accept the rent. What should I do now? What are my options?

How to convert residential property to commercial

My house is situated in Mumbai and it is the bungalow.

I am the sole owner of the property.

The taxes to the government is paid by me.



I would like to convert my ground floor to Commercial as I would like to give my ground floor on rent for the use of restaurant.

I have already received the eating house licence from the bmc however my property still belongs to residential category.

How to know if I am eligible to let out my property for commercial usage?



how to convert my residential property to commercial?

is it possible if my house comes under the R1 zone to convert to commercial?

What is the procedure to do so?

is it advisable to give the place directly on rental to a restaurant without converting to commercial or getting the approved plan, or can this harm me?

I pay commercial property tax.
I pay commercial electric bill.
I pay commercial water bill.

I just don't have the approved planned for restaurant.

Right to husband's property after his death

My husband died without a will. We jointly held immoveable properties which were self acquired. Also there are some moveable properties like shares for which no nomination was made. I have received amounts from insurance and employment settlements as a nominee. I believe as per Hindu succession ( we are Hindus) me , my minor daughter and my mother in law are the only legal heirs to his properties. What documents should I get prepared like succession certificate or the letter of admiNistration ,which gives me absolute ownership and rights to his share of properties and other properties held by him. Thanks.

Partition of property family settlements (relinquish)

Here the property in question is inherited property (After father demise)


1. So if there are 3 co-owners in the property and one of them relinquish his/her right then other two co-owners will have equal rights in the property post the transfer invite no stamp duty like 7 % (state wise)

2. However if So if there are 3 co-owners in the property and one of them relinquish his/her right only in one co-owners favour transfer invite stamp duty like 7 % (state wise)

This mode is highly used in family settlements where the property is co-owned by many legal heirs and one or few of them wish to release the right in favor of others for or without any consideration.


Here above both the conditions are true.

Please advise.
