I wanted to know a few details about Khatas as i am very new to this field.actually we have a property which is under the ownership of my father and his brother.at present my father has been expired. And my mother is also expired so me and my brother are the left overs.And in the other hand my father�s brother is also expired and his wife and a son is left over.so what is the legal procedures we have to follow in order to transfer the khata?? Pls help

The surveyor after surveying our residential plot (300 sq yd) purchased in 1967 he gave the remark as our land is 25 sq yd less and he took the signature of mine along with other two who present. Hiding the above remark, the surveyor has given his report as the land in question was not demarcated due to non availability of link documents. How can I understand the actions of the surveyor.

Sir , I was in defence service and and my expired in 1986 and left behind a registered will in 1979.
due to certain exigencies , it was not possible to come and every now and then for the probate of will.
As per the will there are eight legal heirs and out of which three are the only beneficiaries and out of three one was not in favour to transfer the property in mother names as he has already taken his share and secondly , second beneficiary also does not want to give the copy of the registered will as it was with him for the safe custody. So i left the service in 1991 and since then i tried to get the copy of the will but i failed to do so. But in 2013, any how i got the certified copy of the will from him and want to get probate by the time since then my health does not permit me to do so, and in 2016 i met with an fetal accident and now i am little bit able to walk and like to probate my will in the court, is there any time limit for that or i can file the probate application in the court now justifying the facts
Second suggestion i would like to know that can i sell my share in the property to some other person other then the legal hires..

Dear Sir,
In August 2017 as per procedure State Cooperation Election Authority officers took elections in our Society of 20 Members in Mumbai. 9 members selected & MC Committee also selected by Election Officer. Election Officer declared & submitted the official report.
One member complained that selected Secretary (rented out flat long time back & before 2016.) so he cannot become Secretary.
Sir, please guide on this
1) Can such member become Secretary. If YES/NO - pls give any bye-laws reference
2) Can that Secretary become normal MC Member & make other MC member as secretary within society meeting or election officer again required ?

Dear Sirs,
I have given guaranty in my brothers home, which has been now defaulted in repayments to the tune of Rs. 2800000/-. Bank has given notice of 60 days for dues clearance. kindly inform what is the liability for guarantor in this case. will it also effect my CIBIL ratings.
My grand father cultivating the agricultural land .bagar hukum saaguvali since 1956 we have applied plenty applications to tahshildar office for grant and issue the saaguvali chit.and also my GF paid TT fine 7 consecutive years But in 1961 and 1970 tahshildar issued a notice to call for revenue court (I have original notices) due to I'll health GF not approached to tahshildar office in 2000 my GF expired..now LRs are cultivating the land.2017 tahshildar issued a notice 10/09/2017 under sec 94A and B that ur land is comes under 18 km from bbmp territory so u r in authorised occupient of 2 acre land ur application form 50 f for granting land is not acceptable...as a illitrate what I should do? Which authority I should approach. What are my defence?kindly suggest me sir

My father a retired govt employee has self acquired property in the form of a house of 30*40 in Bangalore. We are 3 bros and no sisters. From the time the property was purchased I was not involved in the decision making and both my elder brother and younger brother were enjoying the property. Parents were with them. Elder brother after 4 years of stay had a dispute with my parents and shifted away. I was all alone staying away since only two families can stay in the house. The younger brother is still occupying one portion. Both the bros during their stay have not paid any rent to my father and have been enjoying the property which I was not having. Can I claim my share of rent from them now. Or else when the property is divided can I claim more since I have not been getting the rent benefit. Legally how I can proceed? My bros have benefitted by way of rent and other monetary benefits from time to time which my parents also feel is not correct. Kindly guide.

hi i am residing in a apartment from July 2017 but i made a rental agreement for that in nov 2017. Now i have applied for passport and in that i have to put that i am staying in here from July 2017 and my owner is aware of that but on my agreement the date is November 2017. What should i do now?
Conditional sale putting a clause in the sale deed .
Respected Sir,
One person sold to another person a self contained flat in the same building wherein the owner also resides in another flat the land comprising the building being also originally belonged to the owner .. The seller had put one condition that in case of the buyer selling the same have to approach first to the seller for buy back the same. Now after demise of the buyer his heir wants to sell the same and approached the original seller but the person neither giving clearance for sale to any third party nor taking any positive step to buy it under market price and unnecessary delaying the deal .
Sir, is the above said clause in the sale deed valid or void as per sec. 10 of TPA, 1882 .
Please help me with your valuable inference .
