regarding the share in the property

hi sir iam a sunni muslim my father has a small plot of 100 yards on which me n my brother have constructed one one floor n now i want to construct anothar floor but my father does not want me to construct n he want to give it my sister who is already married ?what r my rights as his son sir ?moreover it was purchased by my grand father 50 years back.. thanks in advance sir

Property matter dispute.

My mother-in-law had bought a flat at ghaziabad 2 years back ,with her own money, and all cheque payment. But the flat was registered in her son's name. Unfortunately he expired around 6 months back, and his wife is not willing to accept my mother-in law, she has kicked her out, and is now staying with her parents in the home that was bought by my mother-in law. Also my mother-in-law has in her possession a letter, in which her son has mentioned his willingness to transfer the property in her name.

kindly let us know if the above said property can be registered in my mother-in laws name, and whether she can take legal possession of the flat and throw out our Bhabhi.

Schedule tribe

Dear friends


I am purchasing one land with structure in Kolkata.

My query is the that said property is in the name of the lady who was Hindu Adibasi (Schedule Tribe) but she married a Muslim man and accept Islam as a religious become Muslim, after that said property was purchase from the husband money in his wife( i.e. Schedule Tribe) name.

Now
According west Bengal Land Law, one cannot purchased the property of (Schedule Tribe or Adibasi) without the permission of the Land Collector.

I want to know that lady after accepting Islam still have the status of Schedule Tribe

How can i proceed futher?

There are two cases. 1) The property is owned by my grandmoms mom. she has three children including my grandmom. 2)This one is owned by my grandmom's brother, he was not maried and therefore had no children. Now both are dead and the property is not in the name of any particular person. My question is ,

1) Does my grandmom has any share in any of these property?
2) If yes, then being a girl child is there any particular ration in both the cases.

Mutation--Non co-operation of Family member ,half way?

Family member"X" agrees for a settlement with "Y". As per agreed terms the "Y", applied for the Mutation. During the process"X", retracted/ not co-operating for the process to continue. On the request of "Y", the Revenue Authorities to served a notice on "X". The following reply is given by "X":

(This reply is given by "X", One day prior to due date of Hearing)

"With reference to your above referred notice on the basis of alleged claim for succession by"Y".I am to state that the application of "Y",if any,filed by her is not sent along with notice to enable me to give a reply. You are supposed to send a copy of her claim petition along with notice. In the schedule typed in the notice, the basis of the claim is not mentioned.

We request you to give a copy of petition to enable us to reply.

Rectification of my sale deed

Dear Sir/ Madam,

I have purchased a plot from the BMRDA approved layout. My plot comes in the two survey no whereas in the sale deed they have mentioned only one survey no only ( each survey no is belongs to two different land oweners my land developer has taken GPA one is registered other one is notary GPA) and month is mentioned as "Ovember "instead of "November ".

When we checked with subregister office they said i have pay full stam duty one again for this rectification.

Kindly advise me on this..

Need a solution please!

Open agricultural land,tenant"T"(Entry is in the 'Akraman dhar'column, for a period of 10 yrs.)of the land sells( not through the Register document) the same to "X".Some how "X" manages in Thasildhar office to enter his name in the'Akraman dhar' column(period 1989-1991).


Tenant"T", dead long back.But the lands are in the position of Mr."X" even to day.

But all through these years(Even, As on today i.e.25-12-2008), the pattedhar(OWNER'S) column is carrying the name of actual pattedhar(but for the above period).


What are the options available to the Pattedhar,to take the position of the land?
