my grand father have 3 sons and 4 daughter.he died in 1957.the self earned 6 acres of land he leaveswith outwe any will.from that period only one son enjoyed that property and all the revenue records showes only his name is owner of that property. now he sold the property to the third party. if the others have rights to contest the sale deed by him
what are the rights of Karta in HuF proeprty? Can he sell out the property without obtaining consent from other co-parceners ?? what Law is says?? Please give me citation concenred with the same ..

I am a tenant, an eviction petition was filed by my landlord,a "Reply" was filed by my Advocate.
But my Advocate made so many logical,legal and factual mistakes.In fact,he was not supposed to file a reply but an "Affidavit".
I wanna withdraw my "Reply" from the court and wanna submit an "Affidavit".Is it possible and can I file "An Affidavit" on next date ?
Dear Sirs,
This is regarding my grandmothers property in which there a four share holders.
The original documents related to the house is with me and my 3 aunties tried to get the katha transferred to their name without my knowledge for which i have given an objection with ARO's office and they have stopped it as of now.
They trying to all possibilities to get the katha transferred with some political leaders influence, which was told to me by the people working in the BBMP.
They have also constructed a small wall on top of my house and occupied my only exhaust (window) by building 3 sided wall against my wall and creating a ot of propblems. I tried to break it down and they have lodged a false complaint with the police station for which the CI has threatned us by saying if you any thing against the property we will lock you people in. I have given a complaint with the BBMP people to do the inspection of the house, so foar no one bothered to take a look of it as it is in a critical position (can break my ceiling and fall inside the house).
Looking for you advice as to what to do next. As the police, BBMP and event the corporator of my ward are refusing to help me in this.
Couple of sons of my aunties have threatned me to submit all the original documents (which is with me) or to face consequences.
Looking for your kind advice.

I have taken a property on Leave and License Agreement basis in Mumbai through a Real Estate broker now my owner wants to Sell it. Owner is keen to sell his property (in which I am staying on rental basis) to me, my broker is asking Brokerage on Sale Transaction (his logic is He introduced owner to me otherwise how owner will contact tenant) Am I liable to pay brokerage, is there any such Practical practice or any Law for this where I am bound to pay brokerage, kindly suggest.

Sharing agreement (between the landlord and the developer agreeing to share certain flats or floors in the said complex or any percentage of built up area agreeing to share amongst them)that is executed along with the joint development agreement for construction of any complex do require registration? Is it mandatory that this sharing agreement to be registered before the sub-registrar. else what is the proceedure to validate the sharing agreement.

Respected Sirs,
I am an owner of a 1 BHK flat in Pune & let it out on leave & license basis. Towards the same my current tenant whose term of stay is to expire coming Nov 2010 intends to increase his stay for an extended period of 5 months. Please guide me as to the time frame within which the I have to re-register the leave and license document so as to make the agreement binding. Also could you pls. tell me if the term for leave & license agreement is fixed for w.r.t. no. months viz. 11 or 12.

we purchased a commercial property and written an agreement from the land lord, but not registered the same agreement and mentioned inthat agrement "money has to pay with in 3 months to the land lord".
after 2 months only when we take money to the landlord (actaully we sold out all the existing property to pay this money), the land lord done registration to his wife and says i will not do the registration as the land rate got increased with in 2 months only.
can you please advise me, how to approach this situation, is it possible to do the following things
1.first , To stop the rents to the owner in that comemrcail property, there 12 shops in that property
2. to get it transfered to agreement person name.
please adviase and assist me inthis case.

I have filed an Eviction petition under DRC Act,section 14-D,in April 2010.
The leave to defend application was to be filed by the tenant within 15 days after filing this petition .
He filed the same on 15th day.With this application he was supposed to file a detailed affidavit which he did not filed.
I filed the rejoinder on next date.
The matter was put on Argumentation yesterday,but in spite starting the Argumentation,the tenant appeared in the Court with a fresh Advocate and filed a fresh application describing that his PREVIOUS ADVOCATE committed a mistake of not filing the detailed affidavit hence he has brought in the new advocate and now he should be allowed to file the fresh Leave to defend application and he be allowed to withdraw the previous REPLY filed by him.
Surprisingly Judge allowed him to file the fresh Leave to Defend even after telling me to him that it is not maintainable.
Now after reading the fresh leave to defend application ,I am surprised to see that he changed many of his stands taken in the previous leave to defend application.He denied the admitted facts,he admitted the denied facts.
Please enlighten me what is all this happening in the court?
What is the probable fate of this case?
Procedure for becoming sole owner by inheritance
My father expired intestate and left a property behind. The legal heirs are my mother, my brother, and myself. My mother and brother wish to relinquish their share of the property to me. The property is currently registered in my father's name.
What is the procedure for making myself sole owner? Is it necessary to obtain a succession certificate from the court, or is there a simpler procedure for a legal heir to become the new sole owner?
