i have partnership business having 37.5%share. we are having two plots in the name of the firm. can i have my share without selling that property at the same place. please recomend me the civil lawyer for this case in mumbai.

I have two brothers and two sisters. One of the sister was married fifty years ago an the other is not married and living with my paraents. and both the brthers are out of country. Twenty years ago I have purchased some lands out of my earnings and due to affection and respect these were registered in my parents name.All my two brothers and two sisters know this. Recently my mother and father wanted to transfer the lands in my name but as I said this need not be done till they are alive.However one year ago they have written this in a stamped paper of Rs.20/- value apportioning a portion to the unmarried sister and balance to me. Myself and my sister alone know about this document. Now unfortunately both of the parents have lost thier mental balance. As I mentioned earlier My another sister married some fifty years ago and the property were purchased only 20 years ago and not out of any ancesteral property. Both my brothers are married and well settled abroad. Though they are alive now, but If any unfortunate thing happens what will be the strength of the document written by them.will my other brothers and sister can claim the share since the property is in my parents name. Kindly advise.

we have applied for injuction case for plot in the court and as a evidence to be submitted in the court we have applied for certified copy of the registry in the local registrar office .but local regitrar office replies us that the all the documents regarding our plot are gone to the vigilance department and they are unable to give us the certified copy so sir i want to know that what i can do and also sir please tell us that whether the local registrar office have computer records or not and the local registrar help us.

my friend's father inherited 3 cents land from his mother as his share. he then purchased 3 cents each of his brother's share from 4 of them . now he is not willing 2 give a share of this 12 cent land 2 his daughter can he do that?

I have a cousin who has spent most of the last 40 yrs in Africa and Europe but her father was sending money every year to India to buy land and agri land. Her father has been dead now for at least 18 yrs and recently her husband died abroad.
Now she is wanting to move back to India and claim her deceased fathers inheritence of whatever share is hers. Her cousins(fathers briothers sons) in India are not being co-operative and say that the dead father did not want to give any share to his offspring although the daughters sons where told by their maternal grandfather when alive that they could live at the farm and land in India whenever they wanted.
she has not got any idea of the legal proceedures of India and so cannot file any case or such. What is the best advice any of the experts can give.

My father died intestate in 2009 leaving behind me (only Son), Mother and 2 Elder sisters (both Married).
Now my mother wants to sell the property my father had and share the property equally. There are property in my mother's name too, which I want my mother to settle now itself, since I doubt it will go to my sisters only. My question is Do I have the right to ask my mother about the details of the medical expenses borne by her for my father? But my mother does not want to share these details and have filed a Civil Suit in Madras High Court. What will be the expert advice towards this.

26 October 2010 Since your grand father has given the property through WILL to his three sons, no one other than the three sons can claim any right over the property.

26 October 2010 Please indicate whether it is your grand father's self-acquired propery or not?
(2) Is your father only child of your grand father or there were others - if so details.
(3) Your father got this property in his name after death of his father (i.e. death of your grand father).
(4) What about your grandmother - is she alive or has she died. If died, when did she die?

26 October 2010 it is not my grand fathers it is his fathers, my father is the only son to my grandfather after my grand fathers father died and my grand father died the propety passed to my father my grandpas did not make any will but my father made the will to my brothers of his father and grand fathers property my mother died in 1982 my father made will to my brothers in1968

prior to 1956 the will made to my 3 brothers only by my father in 1968 and did not mention my mother name ,he wrote in the will that the property should be divided by three son and died according to the will they divided themselves by my brothers they did not mention my mothers share nor daughters.
my father died in 1969
andd the property divided by brothers in 1974 did not mention my mothers name in it
and my mother died in 1982
now i can claim that where is my mothers share , that share should come to daughters as mothers gift

26 October 2010 The act of your father is totally illegal as per the Hindu Law. The property in subject is inherited property as per details provided by you. The will of your father will stand null and void. You are advised hereby to file a suit for partition of the total properties left by your grand father without any delay.

i can file a suit on my brothers for the share or i can file a suit be-half of my mothers share because when my mother was alive neither my father mentioned her name anywhere neither by brothers didnot mention her name for her share when they made partitions to themselves so pls ans
