land share in appartment

I have purchased an appartment recently. I have following queries.
> Is it upto builder only to decide how much land share flat owner should get?
> Can builder consider his illigal flats in the appartment while allocating land share to flat owners?

No. Each flat owners has got equal share of land beneath the building. The flats do not include unauthorised structures. However, if the unauthorised structures or residential unit is later sanctioned or regulaised by the Municipal Authority then it has got the share in land.
