Me & my brother-in-law have purchased one flat ( 2BHK) each in the Building newly consturcted by the subject Developer. The carpet area as per the agreement, which is already registered, is 631 Sqft each ( he superbuiltup or sellable area 890sq. ft)
It was then submitted to to Bank for Housing Loan. The Bank in turn send for the valuation of the flat.
1. The carpet area shown in the report is 577 sq ft as against 631 sq ft ( which includes 3 balconies) as per agreement which shows abnormal difference between the two.
2. Builder is saying that report did not consider the Door jam areas of the two bath/WC and the two bedrooms. Even after adding around 9 sq ft. it is coming to 586 Sq. ft againt 631carpet area and turns out 826 sq.ft as superbuit up against 890sq.ft.
3. This measurement was done in fron of the Builder represenative.
My queries are:
1. As per the law can builder include balcony space in carpet area. If yes what is the multifactor considered ( 1 or 0.5)
2. does the door Jam area gets covered in carpet area.
3. What action we can take?
Our expectation from the developer will be to charge us atleast for actual carpet area only and settle the difference by making a supplementary/corrective agreement if need be.
Please advise the options we have !!

I am the joint owner for the 2BHK in Mumbai with my mother as the 1st owner, my query is now we have decided to live separately,my mother is a widow & retired but owns 2 other houses also in her owm name. The investment done for this 2BHK was 50:50, she invested 20 lacs after selling one of her house and I took loan of 20 Lacs for which I am only paying the EMI of 20236/- from the start of it.Now my mother is asking me to stay separately with my wife & 1.6 years old son & asking me to sign the papers saying that I have no interest in this 2BHK and stay away. She alone wants to stay in that house with my sister, who is married & came here after her pregnancy. I have left no option of either selling this 2BHK & dividing the money or going away & stay on rent. She is capable to pay the balance EMI, but she is asking me to give her the NOC that I have no interest in this property & go away. What should I do, this is the only life time investment I have done.My age is 34 years now & working with good company.
Please suggest should I leave the property or how to divide the money.
Dear Experts,
"A" a Muslim has two children 'P' son and 'Q' Daughter.
in 1964 'A' Died and his wife died long before.
So after death of A- P and Q only are the legal heir.
in 1974 P made an application to enter his name in all properties of his father A. And he became the only owner of all properties of his father by mutation entry number 367.
'Q' is illiterate and has no knowledge about this. she Died in 2001 leaving three daughters XYZ and one son C .
in 2003 P died and his wife M became the only owner of all properties because they have no child.
In her application the pedigree shows that P and M had no child.
Now a lady R make an application to Mamlatdar that she is the adopted daughter of P M. the Adoption procedure has been done 40 years before. and along with that she bring a copy of will (may be forged) with thumb impression of M, indicates that R is adopted daughter of P& M so Mamalatdar agreed and mutated the entry in favour of R.
XYZ and C had challenged the mutation entry in assistant collector he succeed but Collector reversed the order of assistant collector.
Here R filed a civil a declaratory suit to become absolute owner of the properties.
Now question is that, after 40 years passed, can XYZ and C can challenge the mutation entry number 367 in which P excluded Q?

I have bought a 2 bed room bungalow just outside Ahmadabad before 4 and half years. i have got in to sale agreement ( Registered Banakhat ) with the builder and in that Registered sale deed the procession date is also mentioned. Its more than 18 months of delay from the stated procession date and he has still not given the procession of my bungalow and still keeps giving me targets of 2 months and things are being further delayed. The quality of construction is also deteriorating due to the house left half constructed abandoned.( i have taken pics at regular intervals during my visit on site)
I have 3 questions
1) First he need to gives me the procession of my bungalow in next 2 months, as per what he is saying now.
2) and secondly even if he gives me the procession of my Bunglow ,what about the other Infrastructure like electricity ,water ,drainage ,roads etc to use ,as the overall premise is in no state that I can even access it at night and reach at my house with no light in common areas/roads.
3) I have made the entire payment at the time of booking only. There are no dues I have to pay to the builder.Am i liable for any kind of compensations?
Can anything be done to pressurize the developer to complete entire scheme ??
Thanks in advance
Service association for the plot owners
I wish to get guidance on the subject matter of HOW to form the plot owner's association and the prevailing laws in GUJARAT. The association to be formed is to maintain, manage and develop the various amenities, road, water and drainage systems. Some have guided me to form AOP while some suggest to form coopeative society for the purpose. Please opine
