Filing a civil suit is a matter of right.
If the suit is maintainable then file an application for rejection of plaint.
But no counter case can be filed on this ground only.
Rajendra K Goyal (Expert) 05 November 2014
They can file suit, defend in case if such suit is filed.

If the parents have expired intestate, all legal heirs have right on their property owned by them.

Show all documents to a local lawyer and consult.
T. Kalaiselvan, Advocate (Expert) 08 November 2014
The court will decide about the maintainability of the suit, but one cannot prevent anyone filing a suit against him, defend it properly.
