Occupational certificate

Hi

We have got our building redeveloped & the possession was given last year. however the occupational certificate was not issued by the builder saying that the certificate would come in in 3 months time & he had applied for it

Only last month the officer from the municipality came in to see the building. he did not have a look at the entire building & said that the 12th floor of the building was illegal & that it would cost is 1 cr to get the certificate & we wold also need to pay him 20 lakhs over & above that.

i wanted to know if there is a way we can find out if the building's 12th floor was illegal as we have always seen the plan with the 12th floor.
the builder is not available for any sort of help & has vanished & is unreachable

also is there a way for us to directly apply for the oc & pay whatever the penalty is..... or can we take some action on the builder & have him to pay for this OC

please advice as this amount is very huge for middle class people like us who live in the building

this building has been built in Mumbai Andheri west

SEEKING YOU HELP & ADVICE

Thanking you in advance

Land dispute

sir,
We have purchased a land from 2 different parties in our village in 2007. at that time we did't take any registered documents from them. we make deed in Rs.100/- Stamp paper only and registration was also not done. they have purchased this land from one person but they did't registered and make any agreement at that time. actually the person who sold the property to above 2 persons was died 5 years ago and he does't have a legal heirs and he sold his share of land only. now his brothers objecting us. it was in the name of their father earlier who died about 35 years ago.recently the brothers of the person who sold the land to above 2 persons were came and they said that this land belongs to them only. but in our village revenue record it is showing registered in my name ( it is registered by the officers on the basis of the Govt Order passed in 2011) Sir please Suggest wt legal implications....

Ancestral property--- tracing the title

Respected Sirs,
A person 'X' was owner of a plot during
1897 (original title from Court in 1897 and a root title in his name dated year 1886 is available with me)...

After that in year 1993 'X's grandchildren partitioned that plot into six parts.

There were no registered transactions between 1887 to 1993.

Now, In the partition title document they have not mentioned any details of previous title document or transaction.

Only family tree is mentioned in title including name of Mr'X', his daughter and son, and there sons and daughters (present 6 heirs).

After this two registered transactions had taken place in one of the six plot parts...

I'm now owner of above plot part and want to sell it now.

I got the documents of 1886 and 1897 after much search...other than these titles there is no legal heirship certificate between three generations available.

Sir my question is whether with these above titles can I trace the root of title legally in all respects...

Can a daughter purchase her fathers tenanted property directly from her father

Sir,
I am a landlord of a property in Mumbai. One of my tenants is staying in my property since last 45 years. He has two married daughters who are not living in Mumbai. Now due to age the tenant wants to shift to younger daughters place and purchase a house there and live. He approached me to surrender the tenancy rights to me. A sum was agreed and the premises were to be vacated. Now I have come to know that the elder daughter wants to pay the sum to her father directly and then get the name changed from me without paying me anything.
I want to know that whether the daughter can purchase the fathers property directly from her father. secondly can this be termed as sub-letting.What should be my action if this kind of transaction takes place. Will I be compelled to change the name from tenant to his daughter.
Please advice.
Thanking you in advance.

my father is 2nd son.

one of my aunt has put a case. The inputs are

1. Propery is ancestral
2. My aunt is born before 1956
3. My aunt married before 1990

4. Case is in Karnataka court filled in 2011.

5. The property was made partitioned among sons by grandfather when he was alive in favour of sons in 2001 because their was no opposition by both my aunts during that time.

6. My both aunts has not put a signature in the participation documents.

7. one site each was given to my aunts but was not registered by my grandfather to them. One aunt sold the site to my dad brother on mutual understanding and another aunt who put case sold the site to someone else through my grandfather making signatures to seller directly and also her brothers. the site which inturn again purchased by same my dads brother . This happened before the case was filed.

All was well, until, there was some family disputes recently which triggered my aunt to put case on us.
