My parents have been living with my brother since 1980. In 2002, my parents decided to split the properties (two houses and 10 acres of land) as if they are inherited although I equally contributed to build those houses. He rented his house and has been living with my parents in my house since 2002. I have been living in Bangalore since 1995 and they are in a Taluk. The two houses and 10 acres of land are in his name although I equally contributed to build those houses. I should have done the registration (Khata change from his name to my name) in 2002, but I did not. I am now asking him to transfer the house to my name and vacate it. He is saying that he will have my house by adverse possession. Is it possible legally? What are the requirements for adverse possession?

My friend is purchasing a flat in vasai…one of the agreement clause read as follows:
“by and under development agreement dt—registered in the office of sub registrar vasai at serial no---the m/s xyz has authorized the builders herein to develop building no 3 fsi measuring ----mtrs which is to be constructed on portion of land bearing survey no --- hissa no---- village achole dist thane and to construct the building and to receive consideration money and further the original owners have agreed to convey the said property in favour of the cooperative housing society of the occupants of the tenaments in the said proposed building when formed and upon the terms and conditions hereinafter contained.
Prior to making application as aforesaid as required by the provision of Maharashtra cooperative societies act, 1960 (Maharashtra act XXIV of 1961) the flat purchasers has/have made a declaration to the effect that neither the flat purchasers own a tenement house or building within the area of municipal council virar”
It requires declaration stating that the flat purchaser does not own any flat in that area….even though she already has a flat in the said area….1. why such declaration is required for purchase of flat?
2. what is it legal implication?
Kindly elaborately answer the said query…thanks

Hi Experts,
This query is about my Mom's property. My Maternal grandfather had 2 wife's & 4 Daughters(1 st wife children). My mom is 3rd daughter out of four.
second wife had no children & she adopted my mom as her daughter. entire property belonged to her (land & house). half of the property was shared to my mom through WILL.
Remaining half was shared to her husband(My maternal grandpa)
Grandpa transferred that property to his 1st wife(maternal grandma).
Grandpa:Expired
1 wife: Alive (who has half property now)
2 wife: Expired
My query is, after the death of grandma is that property belongs to other 3 sisters of my mother or my mom is eligible for claiming that property. As the property belonged to grandpa's 2nd wife who adopted my mom & declared as her daughter.
Kindly guide me & clarify my doubts.
Thank you.

I have three brothers and I am the fourth one and parents. We all agreed to split four houses for four of us and parents agreed to live with the first brother's house, since first brother got the farming land along with the house. The documents of Property Division and Release Deed are registered at sub-register's office. This was done on October 28, 2005. Since then, my three brothers and parents are living together in one big house and the other three were rented. My three brothers are now saying that they don't stand by the Partition Agreement and the Release Deed. I live in Bangalore, but my brothers and parents live in a small city in Karnatak. Please advice me on how I can get the one house, which is supposed to be given to me as per the Partition Agreement and the Release Deed. All houses are now on my first brother's name.
Apartment owners association
I have a flat in the 4 storied apartment having 16 flats. Our builder made deed of declaration under section 17 of Gujarat Flat Ownership Act, 1973. In this declaration all the details of property is mentioned and it is also mentioned that association will be formed by the owners under the rules and regulation mentioned this declaration. All the flat owners will be compulsorily become a member of association.
Now, after 15 years of purchase of this property it required some major maintenance and all the owners do not agree for expense. We have not any association till now to handle such situation. So we are planning to form Apartment Owner Association but some flat owner do not agree to form a association and they deny and not cooperate. What we will do? How we make our legal association and fight against the such owners for keep our property in good condition.
