I am talking to brokers to buy (on re-sale) a plot allotted by DDA (to original allotee) under this scheme.
Those who know about this scheme may know that DDA has issued only a payment demand at this stage.
Possession/registry etc. isn't possible immediately and will be done later.
Brokers told me to agree on a price, including premium, with the broker/seller and pay the full money to the seller (by cheque or bank to bank transfer). And get the registry done at a later date.
* Is this deal safe from buyer's point of view?
* Can the seller not demand more money later? How can the agreement on price be documented and guaranteed?
* What sort of documents can be signed with the seller (immediately at the time of payment) as agreement on price and sale?
* Will the documents like Power of attorney, agreement to sell/sale, authorization to sell/sale, ... work in this case?
Thanks in advance.

Sir/Madam,
My sister is a senior citizen. My sister & brother-in-law own a CHS flat, they have no issues. My sister's name appears first on the share certificate of the CHS as well as on the registered agreement, my brother-in-law's name appears second on the share certificate of the CHS as well as on the registered agreement
My sister has appointed a nominee for the flat.
My brother-in-law demised last year. What is the legal position of my sister? Does she become absolute owner of the CHS flat as her name appears first? Should she apply for Letters of Administration or Succession Certificate?
What happens if my sister demises before receiving either Letters of Administration or Succession Certificate?
Thank you all,
Senior Citizen
Could name of expired person can be take as owner in agreement

My friend bought a second-hand-car few days ago. Due to some family issues , my friend now want to sell the car. He has not transferred the ownership of the car yet. Now he don't want to transfer the car's ownership in his name as it will increase the number of ownership. But he thinks that he can't sell the car as he is not the registered owner of the car yet.
If he gets a Power of Attorney from the previous owner , will it help him to sell the car without being the registered owner?
Moreover , will it be legal to do so ? If No, then what will be the best way to sell the car ?
Thank you.
Thanks to all the person who answered my question.
One more thing ; He can sell the car and receive the "delivery certificate". But can he give the party (whom he is selling the car) a "Money Receipt" that he is taking the money for selling that car?

I wanted to know about Private Waqf land sale. We have a land belonging to our private wakf. This waqf only should be managed by our family as per waqf deed. We dont get any income out of the existing land and due to increased expenses to manage the mosque, we decided to sell this property. Therefore, I wanted to know
1) Do we need to seek State Wakf board approval before we sell the land
2) Is it fine to sell a property that does not generate any returns and buy something like a complex etc that will generate returns.
3) For such sales is there any supreme court judgement that references permission for Private wakf muthavalli to sell land. Will registration of such land be permitted?

Sir,
Firstly thanks for the info.
I have checked from Andhra farmers that I do not need any RTC for registration. I can just go and get the registration done. My question is if I get the registration done now I will get the pass book with in one month so can I get my Karnataka land registration with the Andhra existing Rtc.
Kindly reply with your valuable inputs.

Sir ,
We have typical story as follows. In 1979 my father in-law purchased a plot from a real estate developer , who got GPA from the land owner in Mansoorabad, village, Saroornagar mandal,RR dist,Andhra pradesh (Ward:3&block:9) in survey no.:28,29,30 and 44.This land is transferred to my wife vide gift deed in 2002.There about 80 plots in this layout and many construction have come up and very few open plots are there including mine(small shed for watchman and power for that shed). As per the Sub registrar office records , in EC, plot is in my wife's name. In 2009 we have approched GHMC for the LRS to construct a house in that plot and they directed me to get the NOC from ULC dept. When I approached them it was told that this land is having ULC problem and for regulise this you need to pay a huge amount. Then I left from there and approached the group of people in that layout and it is learnt that the ULC dept issued a letter to the owner of the land vide C C NO:J2/176/07 and our people approached the court and there is a W.P.NO:20320/10 filed against the govt. of Andhra Pradesh is pending as per the records shown in the Rangareddy dist. collectors web site under ULC list.I have also joined in that group of people for putting the W.P against the Govt.
There is another big development and the state of Andhra pradesh is divided into two states, Andhra pradesh and Telangana and our land belongs to Telangana state. Vide GO no:59 now the Govt of Telangana state , asking the people to regularise the such lands/houses which falls under ULC by paying 100% or 75% of the rate of the land(open/constructed) as on 02/06/2014.
Now I am in confusion what to do , if I don't go for paying this and don't regularise what will happen , if we are not winning the court case.As per some clarifications in this site , it is found that Govt of India and Andra pradesh have repealed the ULC act . In that case am I safe ? If I am going to build a house , will I get approval? I don't get the approval What I can do.If I want to sell the plot , people demanding the LRS from GHMC and inturn, GHMC demanding NOC from ULC .
So please guide me what shall I do.
with thanks

Can a flat owned under a joint agreement by father and son be transferred in the name of the son after death of father particularly when father has not signed any nomination ? Is succession certificate necessary or merely an indemnity bond will do? Please enlighten.
Deleting of name of deceased member
A society has issued share certificate in the name of three relatives i.e. mother (died intestate)+ son + daughter. Mother has expired on 1.9.2013 intestate and the other members on record in the share certificate has asked for deletion of her name. Pl. suggest the right procedure to be adopted.
