1. Father (from whom iam purchasing) purchased land from some body in 1982 and after that he has given to his daughters as a gift deed ( son is there but he is not good person so he has given to daughters) in 2005 and the same gift deed is cancelled in 2011 and in that mentioned 2011 document property belongs to father only .

I participated in a bank auction and was declared highest bidder in respect of residential property. However, sale was not confirmed as the borrower got stay on "sale confirmation" from High Court.
The bank had not obtained physical possession of the bank but had taken "Symbolic Possession".
High Court case was dismissed later on. Borrower approached DRT and there also the case was dismissed. Bank started proceeding for obtaining physical possession. Borrower then approached High Court and got 1 month stay for any possession proceedings.
Bank now says that the sale is on "as is where is whatever there is" basis and the Buyer has to obtain physical possession. I had paid 25% amount at the time of auction and now the bank is asking for balance 75% amount without handing over physical possession. Bank threatens to forfeit the 25% amount if balance 75% amount is not paid within 15 days.
Request the experts to provide some inputs on the following queries:
1. Can bank wash hands on delivering physical possession of property?
2. Can bank forfeit 25% EMD if balance 75% amount is not paid within 15 days?
3. Does "as is where is whatever there is" means that the buyer has to obtain physical possession by himself?
4. What should be my next action point?
Experts views would be of great help and would be highly appreciated.
Thanks !
Rajiv
In relation to an ancestral property, a registered WILL was executed by the testator in the year 1980, claiming the property as his self acquired property. He bequeathed the properties to his 3 sons only leaving out his 3 daughters. In the year 1987, without revoking the WILL, the testator enters into a partition deed, dividing the property into 4 shares, retaining one share to him and the balance 3 shares to each of his 3 sons.
Question
Wheather the subsequent partition deed entered by the testator and his sons have effectively revoked the WILL as u/s 70 of the Indian Succession Act 1925?

Hi Experts,
My Grandfather was worked in 30+ years and he brought two properties in his wife’s (my grandmother) name by his own hard earned money. She was house wife and doesn't wrote any will. After her death(1989) my grandfather changed Property tax, water tax in his name and using it by himself but property is on my grandmother name only.
My grandfather has one son and one daughter.
Son (my father) - expired, Daughter - still alive
Now my grandfather planning to write a will on my name (grandson) to give the complete rights to me. is my grandfather has complete right on these properties to give it to me or he has only 1/3 rights ? please clarify.
Is my aunty (my grandfather's daughter) has any share on this property ? please clarify
Thanks

My client along with his brother purchased a land . they were purchased in the capacity of partners of a registered partnership firm. My client was facing heath problems and not visited the land for so many years. The property was divided jointly. my clients brother demolished the partition and using the whole portion as it is wholly owned by him. When he just went theirhis brother's son didnot entertain him. Now my client wants to start business in his 50% share , how the problem can be resolved. If I want to serve legal notice what will be the ccontains. My client cannot enter on his own property.
Leased property can be mort5gaged by lessor for his loan
The partnership firm has given on 30 years lease his firm land and building (under construction) to education society. For this building (i.e. construction and finishing work) firm want to take term loan for which bank is also agreed subject to legal compliance (with regards to mortgage of above property) of his law officer but bank’s want to take guarantee of education society, being society is lessee for 30 years. Same law officer is of opinion that society can only take guarantee for he himself will take term loan and not for loan sanctioned to firm. Kindly advise what so do now?
