Dear Sir,
A & B are joint owners of a flat in a CHS and their names appear in the same order in the share certificate. Can their daughter C be admitted as an associate member of the CHS and her name endorsed in the share certificate. Also, is it possible for either A or B to give up their ownership in favour of C in future. What are the formalities. Kindly advise. Thanks & regards. Kumar Gangadharan

I have a query from one of my friend.
As per Indian Law, if property is let out for more than 15 years without any agreement. Is there any chance for the tenant to become legal owner of the property?

The will mad by my late husband in favour of his brothers son in respect of a flat in Delhi was rejected by court for probate based on my objection. But his family is occupying the flat since 2008 as I was serving in army and posted out always. Now I am not allowed to enter.
I have filed a suit to declare will null and void as well as for possession and handing vacant possession against defendant.
Due to delay in case and my retiring shortly can I move application for ad interim possession of a portion of flat so I can have place to live till disposal of civil suit. Is there any law for this or can court do this under inherent powers?
The case is pending for evidence and may take 3 years more but I have only 6 months to retire.

Hello Experts,
My Grandfather brought house by his own hard earned money. He is expired in 1995 and still property is on my grandfather name only.
My grandfather has three legal hires and each one has 1/3 rights.
1) Son (my father) - expired
2) Daughter - alive
3) My grandmother - alive
Now my aunty is going to give release deed for 1/3 share to me with complete money settlement But if she is giving directly to me with release deed then stamp duty is 8% so to avoid this i am planning that she will give the release deed to her mother (my grand mother) then my grandmother will write the WILL with favour to me to give her 2/3 rights (existing 1/3 + new 1/3 = total 2/3). But we are not going to register the Will due to my grandmother health condition. so we are going to write unregistered Will.
Here my doubt is, after my grandmother expire, based on the legal hire - is my aunty or my aunty's son came again and challenge the will and ask her 1/2 rights from my grandmother's 2/3 rights on property ? is it possible and please advice the right approach.
My father had purchased one house during 1962-65 (with his own money - there was no contribution from our Mother [Mother is housewife = not earning member] and elder brother or any one) at Jamnagar in the name of my mother as tradition to buy property in the name of wife. My father has made a will and it indicates equal part for three brothers (Not anything for the 2 sisters as he mentioned that he has already given enough to them). My father was in the Bank as a Manager and my mother was Housewife. At present my father and after mother have expired. My mother has informed every one before she expired that this property will be equal for three brothers. Now, after sometime elder brother comes out with will which is only in his favor and denied to share anything to the remaining two brothers. All family members taken objection and on base of this City Survey office has not register his(Only one name ) name in property card. IssueMy elder brother is also passed away. Before my elder brother died he has made one agreement Dastavej sale of this house to someone. Sale transaction amount is 20.Lacs. Official vale is 4. Cr. This will and Sale transaction both are doubtful. My question is:
Who are the real owner?
Is this Benami transaction?
If yes then under which clause?
Can the remaining two brothers get the share in this property?
If yes then under which clause or Section?
Is legally father's WILL Valid? Document of house is in the Mother. Under which clause?
Is legally mother's WILL Valid? Document of house is in the Mother. Under which clause?

Dear Sir
My father wrote settlement deed in my favour and registered the same. He has included few clauses in it. I need clarification on the same. I have pasted the clause below.
"That this settlement shall take effect only and immediately upon the lifetime of the settlor upto which date the settlor shall continue to enjoy the property as its sole, absolute and full owner with absolute powers of alienation."
Is above statement means that he can sell the property anytime without the knowledge of the settlees ?
Thanks
Possession of flat after death of Co owner
My father (first owner alive) and mother (Co owner recently expired) have purchased a flat in tata housing in Mumbai
The flat is ready for possession now and my mother has expired.
I am the only child of them (no brother or sister)
We requested tata housing to handover possession of flat to my father who is first holder of flat but they are delaying it in name of taking legal opinion
Please help me to know the legalities.
