Absolute power to women in u.p.z.a & l.a. act

Respected Expert,

Is it true that according to U.P. Zamindari Abolition & Land Reform Act, when a woman inherits the agricultural land from his husband after his death, she has absolute power and can give the property to anyone by writing a Will?

Please clarify. An early and detailed clarification will be highly appreciated.

Thanking you,

Best Regards,
Sanjeev Srivastava

Flat given on rent in navi mumbai

Sir,

I own a flat in Navi Mumbai. I have given it on rent in July - 2010 and since then, the same family is continuing living there. For last 3 years, there is not even any agreement between us as there is good relationship.

However, I need to know that

1. whether it poses risk of flat for me ?

2. In Mumbai, generally people change their tenant after 3-4 years, why it is required ?

3. Whether a simple notarised agreement suffices or we need a registered agreement for 11 month lease which is continued from year to year.

Kindly guide me,

thanks,
Pankaj

Forceful entry in undivided portion which is in my posession.

I have 50% right in an undivided property which is of G+2 in which i am using half of ground floor and full first floor and the other co-owner having 50% right is using 2nd floor and half of ground floor. There is no partition in written between us.Since due to employment oppurtunity i with my family need to shift to mumbai. The other co-owner has planned to enter into my posessed part forcefully after we will shift to mumbai which i have heard from sources. Many a times i have asked them to enter into a registerd settlement deed but they are not agreeing to that because their intention is to take posession forcefully in my part also.
1. What should i do so that after i leave for mumbai , that the other co-owner cannot enter my posessed part. Please guide me sir so that i can take precautions in advance.

Survey of the property before khata transfer

I have an house in Tumkur (district head quarters), which is 2 hour drive from Bangalore. My brother has been living with my parents in my house, which was given to me when my father divided the family properties. However, the house is still in my brother’s name, because when it was constructed he registered in his name. My brother’s house was rented and he has been collecting his rent. I am living abroad. He was paying the property tax of my house every year until 2008. Now, I am in India and went to Sub-registrar’s and Muncipal offices to change the Khata registration from my brother’s name to my name. They told me that my brother has not paid the tax since 2008 and before I get the Khata transfered to my name, I have to pay the back taxes and survey of the house has to be done. My question is the following: The survey number, area of the house, and all the details of the property are in the release deed as well as partition deed. I will pay the back taxes, but why are they asking for surveying the house?

Do daughters entitled to property divided after 20th december 2004?

My father has 2 sons and 5 daughters. I am the younger son. In February 2005, my father divided the property of 6 houses and 9 acres of land. My father took 2 houses where my parents live, 2 houses for me, and 2 houses for my elder brother. My father also took 3 acres of land, 3 acres to me and 3 acres to my brother. The Release Deed (Khulasa Patra in Kannada) was signed by my brother and my father indicating that they have no rights in my property (3 houses and 3 acres of land). As per Hindu Succession (Amendment) Act, 2005, “the daughter by birth shall become a coparcener in her own right in the same manner as a son. Nothing contained in amended Section shall apply to a partition, which has been effected before the 20th day of December 2004.” My question is the following: Since the partition was done and Release Deed was signed and registered in the sub-registrar’s office in February 2005, can my 5 sisters claim for my father’s property? Can they go after my brother’s and my property also? Thanks.
