Rights of Son as owner against mother as resident

My question to legal experts

Hello Experts. I and my wife jointly are the owners of the flat where we (me, my wife, my adult son and my widow mother) stay. My widow mother is mentally retard to a certain extend. My mother has made our lives miserable. My self owned business has shut down and I no longer earn any income since more than one year. My wife's salary is the only income by which we are carrying on. My mother is a pensioner. She does contribute five thousand per month towards her expenses. The issue is not about her expense. Its about her behavior. I have an elder brother. He owns a 1BHK flat. He has refused to take her responsibility on the grounds that his flat is "small". I want to know about any such legal rights existing, where we the owners can discontinue the stay of my mother in my flat. Also, can I file a case against my brother in order to share the responsibility of my mother. Please advice.

How to get will copy

Hii I am hindu married lady We are 3 sister and two brother in which our 1 sister has been expire so now we are 2 sister and 2 brother.My father has expired in 1996 and mother has expired in 2012. my father has made a will and registered it but I do now know that when my father has made a will and my brother and sister also against me. So I want to know that how can i get the copy of registered will of my father. I am very Poor lady.

Ancestral property issue

Sir, I have one query about ancestral property.Detail are as follows My grandfather has 3 sons and two sister. My grandfather and his brother got the property from his fahter
1.My grandfather got one property from his father .my grandfather has borrowed some money from some one.he was unable to pay it so second party file the case.
2.In 1971 through court decree there was auction of property and nobody took part on this only my uncle(tau g elder son) and as i know he paid the amount with interest but he transferred this property to his wife's name (x d/o y)
3.we didn't know that he is managing the property as he was there and my father was doing govt. job else where
4.Now he got retirement in 2009 and ask him for property he is still making fool all of us.
5. but when we saw the record in nagarpalika that property has been transferred to my (tai g) aunti name. he is ignoring us Now my question is that A.Was the decree legally right as it is transferred to family member name? B. Could my grandfather transferred whole property to anyone as it was the ancestral property (Note: my father and other all are major at the time of decree) C. Can we file a case for this fraud after 40 years as we were not aware of that D. Is there any time limit to file a case E.If it is possible file the case than should be include their sister as a party (As it is ancestral Property) F.What we need to file case and what are the chances to win.

Builder stopped work nor giving possession

Hi,

I am Karan, i booked a flat in a project from a reputed builder in the year 2010. the project was under construction then. since typical U/C project do not get all clearence initially i could no register my flat as CC for upper floors was yet to be received. i made payments as per the builders demand notice which were raised as per completion of the project. in the mean time the CC was duly received by the builder and my flat was registered. at the time of registration i had already paid 50% of the total amount and during registration found that the agreement was heavily one sided and had no possession date. i raised this issue and was told that i could withdraw from the project but the token money of 1,50,000/- will be deducted this being a huge some for me i registered the flat with the Sub registrar and after that i submitted the documents to my bank for a home loan which was processed without any issue and i got the Home loan. it is now 2015 the builder has already taken 90% of the payment and the project work is completely suspended for more than 18 months. i checked with outher buyers not only in our project but also 8 other project of this builder and found the same modus operandi. what right as a comsumer do i have in this case. since our agreement does not have a possession date does tat mean the builder has complete control. the builder also changed the layout of the project without any consent from the buyer whereas the layout was one of the primary attraction of the project. please suggest what options do we have legally as well as in the consumer court. there are more than 100 such buyers in our project itself. Use and ownership of roof terrace in multi storey flats

I would like to seek clarification on this important issue as more and more multi storey flats are being constructed.

Most of builders including GDA,DDA etc sold roof terraces to top floor occupant. But these terraces are to be sued for maintenance of water storage tanks ,setting up dish antennas etc and should be treated as common property owned by residents society. What is legal status on this issue and should not the terraces and common use areas be owned by welfare society in such condominiums? Is there any judgement available on this

Transfer of property

My friend's mother died intestate leaving four sons and four daughters . She had a commercial property in her name in a town of punjab, the property is in lal lakir. Two sons had already got their share of property thro written agreement years ago. How the property would be transferred to the heirs?

Penalty for paying electricity bill at noncommercial rate

Hi
I have a paying guest and for the last 6 months I had paid the electricity bill at non- commercial rate. But today AE came for inspection and asked for a huge penalty.
What would be the penalty amount for paying electricity bill at residential rate rather than commercial rate

Poa miuse by builder

Hi

Our society had provided POA to builder for demolition and reconstruction of flats.while builder is supposed to pay us rent till possession of apartment at Rs12k per month.The builder had a contract for 4 years to accomplish the same but nothing done in last 3 years.after demolition no work is started expect the CMDA approval.

However off late - for last 9 months builder is not paying the rent
The builder had also pledged some part of the land and he is also planning to sell some portion of land

The Societies president/treasurer are conniving with the builder and they may have a super authority sort of in the society.

What are the options we have (i presume this could be a irrevocable POA)
Please provide steps for
1) getting documents from bank in which its pledged legally
2) revoke POA
3) How to get forcenics analysis of society president and treasurer for conniving
4) how long these cases can go? what kind of expenditure we wil have to bear/how much (just an approximation)
