right of way

Dear sirs. We are 5 property owners who had purchased 5 properties one behind the other and had left a 20 feet road access to our respective properties and we have records to prove that the road is only a private road .. recently the families from our neighbouring lane have requested the city corporation to demolish a wall from our lane which connects to their lane and allow them access through our lane. They have used some money power as well. As such the corporation guys in my absence have carried out an inspection without giving me any notice written or verbal and haven't even asked for our documents . They have directly sent us a notice stating that we have blocked the road and we need to demolish the wall . Even the town map and our property sketch and documents states that it is a private road. The corporation has put tar and drainage facility in our road a couple of years ago but we have never given in writing nor gifted them the land. (Daana patra) does this imply that our private road has automatically become public.what are our chances in this battle ? Can they just come and demolish the wall with one notice ? What are our options now .

Supplementary agreement

hello,
my leave and licence agreement was ended on this 1st October 2015 and it was registered agreement for 3 years now i want to make supplementary agreement for 6 month of period untill the rent will be finalized by two parties....... then after we renew our agreement for next 3 years....... so plz reply is it possible to make supplementary agreement for next six months?

purchasing of land from dohlidar in haryana

Sir rajput A donated one care land in 1986 to brahmin B in haryana mahendargarh district. B sold land to me at same time on registered degree. We obtain the signature of borth parties A and B on degree. But after one month only B filed a case in district court against me that donated land could not be sold and challenged my degree. The lower court didn't accept my degree and failed the degree in2002. Then we filed an apppeal in high court Chandigarh against the lower court decision and same is still pending in high court. The intkal of land is still on name of A. Now B wants to get agreement with us for some rupees and want to give land to us. Now my question is whether this agreement is possible and if yes then would my degree will be valid and land can be transferred on my name by this degree? Second the propriety rights act 2011 of haryana govt could effect my case?

Possession to 50% of flat

We have an ancestral 600 sq flat in a housing society . It belonged to our grandfather. After his demise the Flat came to be transferred in the joint names of his two daughters - A & J who were then his only surviving heirs. Both daughters- A & J were married had families and have since expired 10 years ago but the flat is still in the name of Late sisters since there was no unanimity amongst legal heirs of A & J . A had not filed any nomination nor made any Will and even today there is dispute amongst the six legal heirs of A . However J had filed nomination & there is no dispute amongst the three legal heirs of J . The legal heirs of J have obtained Letter Of Administration from High Court & submitted to Society. Society has therefore transferred 50% rights in the said Flat to legal heirs of J . The Flat is in possession of one of legal heir of A. Now legal heir of J ( who are staying elsewhere in rented Flat ) want to occupy 50% of the Flat . As of now legal heir of J is member of society , paying society bills & holding Flat Share Certificate. Can the legal heir of J go & occupy the Flat? What remedies do the legal heirs of J have now as they are still deprived of the Flat premises?

Building plan on gair abad land.

Raj kumar few yrs ago purchased a land and got his name mutated in register 2 and have current rent recipts. a problem is that he has NO approch ROAD OR PATH CONNECTED to his piece of land , and, now ANCHAL KARMCHARI SAYS THAT THE LAND BELONGS TO GAIR ABAD KHATA LAND. Raj kumar wants to construct a multi story appartment in his land .For this he approche several mediators ,Developers and they are ready to purchase his land. IF I WANT TO BUY A FLAT IN HIS UPCOMING PROJECT , IS IT BE MY GOOD DECISION ? WHETER HE GET BUILDING PLAN For his appartment AND ANY BANK WILL PASSE ANY HOUSING LOAN IN THAT PROJECT ? 1. LAND BELONGS TO GAIR ABAD KHATA. 2. NO SEPERATE ROAD OR PATH FOR tht LAND. 3. NO ONE IS READY TO GIVE PASSAGE FOR THAT PIECE OF LAND .

Transfer of property in name of mother

My wife has two brother. His father is not alive now. Her mother have some property jointly with her father and some with the name of her father only. Now her mother wants to transfer all property in her name. What is the procedure? One of his brother so arrogant and always bother her mother is it any way to transfer all property without involving him.

Power of attroney

I want to give power of attorney to my father in law , who is staying in delhi, for management of my property in Delhi including putting it on rent and receiving rent on my behalf. The property is half owned by my wife. We are staying out of Delhi but within India. pse advice if it is legally permitted.

Nri and agricultural land inheritance

Sir/Madam,

I am PIO card holder, born in India and currently hold US Citizenship (NRI), but settled in India for good. We are from Agricultural family , owns quite a bit of farming land and most of them was self acquired by my father. He kept half of the land in my mothers name and that has become self acquired property by her own. My father died last year and in the process of dividing the property. We are only two sons and no daughters and the property division is very amicable within us. We are planning to do partition deed for my fathers property (as he already died) and gift settlement deed (settlement-familiy members) for my mothers property. This is in state of TamilNadu and I believe mothers property always passes like a gift settlement deed when they alive.

Questions:

Being a NRI, do I need to do any other legal documents?.
Will the property received from my father and mother considered has inheritance?
What is the difference b/w gift deed by someone vs gift settlement deed by parents?

Bayanna agreement

my father and his brother(my uncle) have been fighting over a piece of farming land for a long time which my father rightfully owns
finally my father got fed up and decided to sell that piece of land to the same fellow (my uncle )
he entered into an bayanna agreement in which he paid half of the sum initially
and the registery date is due next month
i read the document and i fear that he might have been played
because i am pretty sure he is not planning to give the reamining amount becauses of the clauses
it says
1 if my father refuses to get the registery done at or around the date next month my uncle can go to court , fight a case there and get the registery affair sorted out and also my father would have to pay back double the amount he recieved during this agreement
** but there is no clause regarding
what will happen if they refuse to pay remaining amount before the due date i.e
1will there be any consequences or penalties for my uncle
2does the agreement stands void or unvalid
***my question is that :does bayana document by default means that until and unless the agreed amount is paid by my uncle to my father before due date does my father get to keep the money (initial sum) and will still be the legal owner of that land
because i m pretty sure (my uncle) is planning to get back double the amount he paid if he goes by the clauses

Change of name in electricity bill

Hello Sir, I purchased a flat on my wife name registered as single owner and not as joint owner with my name and then subsequently got the property tax and Electricity bill transferred to my wife name. Now, is there a way to have my name included as Joint Owner on Electricity Bill or Property Tax records either through GPA or Lease. Thanks in advance,
