Donation to orphanage

Dear experts I had wanted to start an orphanage which was my drem. But i understood that I may not be able to give 100% to that for n number of reasons. Still I would like to do something to the many orphans. I have this idea of donating a fully built orphanage to a good organisation who can use it and run. This is my first step towards that. Please help me understand the kind of legal issues that can be faced during this process of building and handing over. Thanks in advance.

Misrepresentation

i have entered into a MOU FOR PURCHASE OF FLAT (RESALE). THERE IS A MISREPRESENTATION DONE BY THE SELLER AS HE HAS STATED IN MOU THAT THERE ARE NO LIABILITIES OUTSTANDING AND NO LITIGATIONS ON THE SAID FLAT. THE SOCIETY HAS GIVEN US A NO DUES CERTIFICATE ALSO. NOW WE HAVE COME TO KNOW FROM THE DOCUMENTS GIVEN BY THEM THAT THERE IS A PROPERTY TAX OUTSTANDING ON THE SOCIETY WITH 62 MEMBERS SOME OF WHICH BEING COMMERCIAL AND BALANCE RESIDENTIAL OF RS. 3.65 CR. AND A STAMP DUTY O/STD OF RS.45.00 LACS SINCE 1999 WHEN THE BLDG WAS REDEVELOPED AND THE PARTY SAYS THAT SINCE IT IS A LIABILITY OF DEVELOPER THEY ARE NOT PAYING IT AND HENCE THE SOCIETY IS NOT HAVING PROPERTY CARD IN ITS NAME. THE PARTY IS NOT READY TO GIVE THE EARNEST MONEY BACK AS HE SAYS THERE IS NO LAIBILITY.I AM HAVING PROOF OF MUNICIPAL CORPORATION. PLEASE GUIDE WHETHER I SHOULD GO FOR CIVIL SUIT OR A CRIMINAL CASE ON THE GROUND OF MISREPRESENTATION/ FRAUD.

Tenancy eviction case

There are 2 societies viz A and B. A is the society owner of the land/promoter whereas B is also a society. NO CONVEYANCE has been done since past 30 years. Both the societies are registered under MCS Act. A leased out the land on which the building is standing for 999 years. A and B had agreed that a nominal rent of Rs. 3600 shall be paid annually. B did not pay any rent as A did not demand any rent either orally or written. B is mortgaged with the MCGM wherein it has been agreed that the flats shall be used and purchased only by the BMC employees.

Now A has filed a T.E. case in the small cause court against B society. The said case was filed by the Chairman of the A society with out any society resolution however the Chairman expired after few months of filing the said T.E. case against the Society. This was not brought before the Court however an unknown person who allegedly became the Secretary of the A Society and pursuing the matter that too without any resolution or authority. A Society secretary is using all his resources to harass the B society members.

Can Small Cause court entertain the said TE case as the case has been filed without any authority and the alleged the Secretary has made forged documents like rubber stamps, illegal and fake resolutions?

Can A society secretary's misdeed can be brought up before the court?

Can A's society demand for the rent of 30 years @ Rs. 3600 p.a is legal?

Would sincerely appreciate if any citations are given.

Please help by your valuable advice.

Property in maharashtra

I am a Muslim Indian male. My father had a leased Room (pagri system) in Mumbai and a house he built with his money on Govt land (Gaonthan) in Ratnagiri,Maharashtra. After his death, the same was transferred in my mother's name. Now is my mother, 75 yrs old, the owner or heir of the property? Do I have to take her permission to reside in the property? Can I use the property without consent of other heirs? What if she is not staying with me or does not want to stay with me? Can she claim maintenance as per the new Act 2007?
