Deed of declaration

HI Experts I have an apartment in Gurgaon and as usual feel that Builder is playing havoc with the rights of the customers.... As per his approved plan, there is supposed to be a community center and he is claiming that this is a club owned by him. He has filed the same in his deed of declrations too. That gives rise to following questions - under Haryana Apartment Owner Act 1983, what is the legal relevance of Deed of Declaration and can the builder file something which is not as per approved plan - what is the remedy available to the customers Lastly what is the exact legal relevance of Deed of Apartment which has to be registered by individual Apartemtn owners. Also, how to get deed of declaration of builder not sharing the same. Thanks

selling trees from property without owners knowledge

Sir , this case is between a mother and son.according to the fathers will a property was equally shared by the above said.due to family issues the same property has been partitioned and made separate deed and registered. The house in this property is for mother and the mother allowed son to stay there for 2 more months till they find another place and the mother stayed with her relative because the son is kind of a criminal nature.during this time without the knowledge or consent of mother he sold the trees worth lakhs which was there in the mothers property alone and didn't even touch his side trees. The mother now had nothing to earn money for a living. Is there any way to help her legally or thru local police.

Lease out term for commercial property

Dear Experts,

I own a bricks manufacturing field in west bengal and had leased out that property to one of my close friend for last 11 years (lease ending 30th April 2016). Now he wants to continue the lease and asked me to extend the lease for next 11 years ( can be a renewal or new deed as he is OK with both the options).

Now question I have is:
1. Is it safe to extend the lease to him for next 11 years and if yes, what would be my terms and condition.
2. If long term lease is not advisable as he already completed 11 years, can I give 60 days gap in between the current lease and signing the new lease? Is that's a good deal?

Stay from selling property

A lady filed two separate suits in Family Court at Mumbai for conjugal rights (civil) and maintenance under Section 125 of Cr.PC. An order is passed for restitution of conjugal rights against her husband who is working in Gulf and having live in relationship with another lady. Maintenance suit is pending. In both cases, the Respondent is not appearing in Court.

The husband is having self acquired property in Tamil Nadu. He is trying to sell the property himself or through Power of Attorney Holder.

The couple is having a daughter of marriagible age. Wife approached Family Court in Bombay for an Injunction from selling the property but the court said it does not have jurisdiction since the property is in Tamil Nadu.

Can the wife file a Civil suit or any other suit in Tamil Nadu and get a stay against selling the property since the wife and daughter have a right in the property. If not what is the solution.

Please let us have your valuable advise.

Thanks
