Minor's property - sale by mother the guardian

one grand mother settled her property in favour of her 3 grand minors children under a regd settlement deed. now one minor became major., other 2 are minors. Their mother wants sell the property and she obtained permission for 2 minors from court.
kindly tell me what certificate need the major child to sell her share along with other minors?

Land conversion issue

Dear Sir

I have entered into the property conversion of my plot with a builder in Ranchi (Jharkhand) in the year of May 2014 through non-judical stamp paper between the directors of Builder and my self duly signed by the two witeness. by giving 25% of token money as agreed of 10 lacks total(token amount) by cheque.
now after spending apporox. 3 years neither initiation has been taken from builder to develop my plot as agrred. and they keep delaying by giving no. of execues verbally.


i am thinking about withdrawal of agreement made between us.

as the builder is using my plot primises for living since entered into the agreement to developing the apartment.

from no. of sources i heard that builder is not interested to develop my plot in near futur.

as on now i have revcied only 2.5 lakhs through cheque as token money only.

please suggest me. what should I do.

Property purchase disputes

I have purchased one plot in 2014. I have completed all legal formalities related to purchase including registration and 7/12 and pher phaar entry etc. Property having clear title on single name. But now old land owners wife is claiming her right on property due to their divorce case. Is their any legal risk to my property?

Need help: 45 year old tenant not evicting.

he case is, my great grandmother let out ground floor (2 rooms) of our house to a person in Gujarat. He passed away many years ago. His family continues to stay there. My grandfather lost the case to increase rent in 2004. We want to evict the tenant due to family reasons. We offered them monetary compensation yet they asked for 7 times more then what we offered, even our property doesn't value that much. They also threatened us by saying "do whatever you want" What are the options available for us? Can we win the case or is it okay for forced eviction? Please explain in detail.

gift deed

My grandfather gifted me plots of lands through gift deed authenticated by Notary Board.
In the gift deeds my age is printed as about 28 years whereas when the deeds were signed I was 34 years old. Will I have to rectify the same or it's normal and will'nt torture me in future? Please advise me.

Purchase by Auction

I have purchased a flat in Auction. I have paid Full Amount and received highest Bidder Certificate, Sale Certificate and Possession Letter from Bank.

The flat was on the name of Defaulter and his mother (Joint Owners). Now the elder brother of Defaulter claims that he has filed a suit against his brother to get his share in the said flat. This suit is at the stage of Application and has not even been listed on the board of Mumbai High Court. There is no Order of any court with the defaulter's brother or Society which prevents possession of the flat.

Society doesn't allow me to take possession of the said flat, giving me the reason that the Defaulter had given them a letter stating that the flat is under the dispute of both brothers in high court. I have read it properly. Applicant is Elder brother and Respondent is Defaulter. Applicant claims that his younger brother and his mother who were the joint owners of the flat had taken loan and defaulted. So he wants his share of property.

My questions are.
1) Can Society prevent me from entering in that flat?

2) What is the legal form of taking such possession? How can I get possession?

3) How can I get out of this problem?

flat number is not mentioned in my flat index2

Hi,
I purchased the flat in resale in 2013,
I took loan from bank and now willing to switch my loan SBI. During loan transfer process, bank came to know that index 2 of my flat is not having flat number mentioned in it.
I repeat in simple way (i) builder to owner1 agreement is having flat number mentioned in index 2 (ii) But owner 1 to owner2 agreement is not having flat number mentioned in index2.
I am owner2 and owner 1 is not in India.
Plz help me how to make the changes in my index2.

Grandfather will

My grandfather was died in 1996. Recently (2015) my father and uncles had dispute about the property which my grandfather owned. Now we come to know that one of the prime property on my Grandfather’s name was transferred to one of my uncle’s name and when we contacted the court,we come to know that the property was transferred on one of my uncle’s name on the basis of Will. I have few questions now.
1) As none of my father’s brother & Sister is aware of my Grandfathers will after his death, Is the decision made by court without contacting other son’s & daughter is valid ?
2) In the will only one property out of 6-7, none has the correct description except the one which was transferred to my uncle’s name (means no address and no land mark identification), is it correct as per the Will law ?
3) The properties which are on my mother’s name and aunty’s name, which my father and uncle bought from his earning are also identified in will as my grandfather’s property for distribution ?
4) Their is no identification of any property with their current market values ?
On the above points, Is the will is acceptable as per Indian law ?
