Drc 1958,

Sir,

The facts of my case are as follows:-
1. There is two co-owner of one shop located at old Delhi.
2. Both co-owner became owner of the rented shop through family partition deed well executed and registered in year 1975.

3. The portion of each co-owner are well defined in partition deed.

4. The both co-owner via single lease deed gave shop on lease in the year 1980.

5.One of the co-owner filed eviction petition for his portion.

6. ARC recently rejected such petition on the ground that " One co-owner cant claim eviction for part portion" because entire shop had given on lease as one unit by both co-owner.

My query is :-

A. As a part of other co-owner, what kind of remedies available to me ?

B.As a co-owner ( both landlord) what we can do now ?

Transfer of property

Hai Experts
My grandfather has self acquired property, which he wish to give to me (grandsons), my grand father having one son(my father) and one daughter my buaa
What is the legal process to transfer Dada property in my name and also in future my father nor my buaaa can make any objection on that property.??

And also that land paper to be in my name

Conversion of land for loan in notified area

Cancellation of lease

A trust has entered in to perpetual lease agmt. with an individual providing for an apartment on lease for 99 years. Now both the parties agree for cancellation. what is the procedure to be followed? Lease agmt. was through a regd. lease deed. whether the same has to be cancelled by an regd. agmt.? and whether again the stamp duty has to be paid?

Builder is not applying for oc after promising for it

We booked a flat in Jan,2016 in bangalore by giving him 20%.We signed all the agreements and we applied for loan.He has received the complete amount and now he is not applying for OC. Recently he made deviation in the construction as wel.What action can we take to get the OC.

Properties related

Sir one of client totally helpless
He lives in joint family his father have two brothers and the land is registered in one of his fathers brother name but now they all are separated when the deed was done they promised my client that they will give that land for ruppes 40k to my client and for the previous 20 years my client paying the all taxes in his name and also residing in that land from the 70 years.
Sir my question what kind of relief my client will get can that land be assumed of my client according to west bengal properties law???

Sale agreement

Hi sir,

We have around 2 acres of agricultural land. There are 4 shareholders to it. We had made a sale agreement with the purchaser to sell the land for 47 lakhs and all the shareholders have agreed to sell the property and duely signed it. Now one of the shareholder is not agreeing to sell the property for some reasons. Can a purchaser file a case against us because the sale agreement tells who ever breaks the agreement needs to bear the entire expense.

Law regarding mentally disabled

When a ancestral property partition takesplace involving slightly mentally handicapped ppl, do we need to notify the court? In case it's not notified is the partition and the registered document considered not legal?

Illegally occupying the property

Hello,

My name is Rohini. I reside in Canada and I have a property in Hyderabad. My parents and my brother came to Canada last year and they locked the property, gave the keys to a trusted person. My sister-in-law who has filed case against us U/s 498a has now illegally occupied the property without our permission and knowledge. She is not vacating the property. My mother is staying at my friend's place. My sister-in-law is enjoying the property while my mother has to stay at others place. I would like her to vacate the property as her own husband (my brother) do not want to stay with her. The police states that they do not have any authority to vacate her and it has to come from the court. Please advice. The property is in my name and i added my mother's name also.

Dispute over shop

My father borrowed 1.25 Lacs in 2003 from a person and kept his shop's registry papers with him and signed an agreement to sell for 1.25 Lacs. After 8 months, he returned the money and the person gave back the shop's registry papers however did not give back the agreement to sell. We sold the shop in 2013.
In 2009, the person from whom my father borrowed money died and now in 2016, his son came to us with that agreement claiming that the shop belongs to him and he'll file a suit.
Please guide.
