Hi,
Ours is a Hindu family. My grandfather use to run a business. He purchased some properties out of the money earned from business (his own income). He died in 1959. He has three sons (say A, B and C) who are all married. Till 1963 the three sons lived as joint family.
In 1963 the three brothers made partition of their father's property. At this time all three sons also have sons (say A1 to A , B1 to B, C1 to C). The property was divided equally between A, B and C. However in the partition deed the grandsons names were also included. A and
his minor son A1 jointly got few houses. B and his minor son B1 jointly got few houses. And C and his minor son C1 jointly got few houses.
Can you please clarify the following:
1. Is the relation between C and C1 is a joint hindu family?
2. As far as the grandson C1 is concerned what is the nature of the property which C and C1 received on partition? Is this ancestral property?
3.Can the grandson C1 file a suit on his father C for partition in the property which C and C1 received?
4. C has one more son C2 who is born in 1970. Does C2 has any right on the property received by C and C1? Can he file a partition suit?

Dear Team,
My brother and myself entered in to an buyer seller agreement in Mar 2015 and expiring on Mar 2017. Now, I have paid 2/3rd of amount to my brother and pending 1/3rd to be paid on expiry date. I requested my brother to extend the time for further 6-7 months. but, his wife is not accepting and instructing me to pay interest for the balance amount after expiry. the property is my ancestor property partition between us 50% each in the year 2011. I am buying my brother 50% share. Kindly advise whether the interest beyond expiry date is admissible and what should I do if I want to extend the agreement period.

LARR 2013 ACT speaks about the compensation to be given to the persons who's land is under Compulsory acquisition. It states that Compensation shall be the 2 times of the market value if land situated in Urban area and 4 times if the land is situated in rural area.
My Question : BBMP (Bangalore Corporation) is planning for road widening and talking about TDR(Transfer of Development right) as a compensation. Whether as per LARR 2013 the said TDR is valid and whether land loser have an option of asking the compensation in monetory terms.
2 nd Question : Section 96 of LARR Speaks about exemption of Income tax for the Compensation, But the respective amendment was not made in the Indian Income Tax Act, whether Income tax has to be paid on the compensation amount?
If compensation is exempt then the interest paid on the compensation from the date preliminary notification is also exempt ?

in 2011, i bought 5 cottahs of land in Bihar from my uncle. it was ancestral land and it was in uncle's share. In 2016, i sold the land to three parties. later on i realised i have mentioned wrong khata khasra in the sale deed. the khata khasra was wrong in the original sale deed too.
what can be done now?
stamp duty will be required to be paid again?
the wrong Khata khasra is of another uncle property.
and the executor of the original sale deed has since gone abroad and is in bad health.
what can be done? will fresh stamp duty be needed?

We are 4 brothers. Our mother is a widow and her age is 89 years. Our mother owns a flat. Instead of making a will, she wants to sell the flat and distribute the money among us 4 brothers as gift. The flat was purchased in the year 1970.Has she to pay long term capital gain tax and how much?

Sir, I am houseowner and want the land below the house to transfer on my name as the landowner is expired 28 yrs back and nobody is claiming the ownership of the land. I am paying the land revenue for last 28 yrs. My house is located in Nasik district in Maharashtra.

My name is Santhoshi. I have a property problem in my family,,
My father was married first wife in 1974. She left him without divorce in 1977. My father married my mother in 1979 without settlement with first wife. First wife came to my father's home after 15years. First wife has a girl (22) divya.my mother have two children. Now Son(Ramakrishna) is 32 and daughter(santhoshi) (24).in 1997 My Grand ma wrote a property vill as 2 portions for grandson trinadh, 2 portions for grand daughter divya and 1 portion for padma. In 1998 vill was chaned to 3 portions for grand daughter divya, another 2 portion for my father. They r saying my mom was stole the gold from my grand ma. But it is not a fact.my father and his first wife createf like that. There is no proof for that. Now the two portion which was allocated for my father, they sold it without my brother sign. We are not sure it is valid or not. And now i do not have any properties and now i do not have any source from my father.even im n't getting any maintenance from father as per court order.They made a wrong petition as my brother trinadh was getting salary and my mother was working. So they don't need any maintenance from my father. Now they are trying to sold remaing properties.
So, can anyone tell me if i have any chances to get any properties from my father.

I am vijay from Hyderabad, I have anscestral land at CHEVELLA rangareddy dist .My grand father has 10 acres land in his name in 1954 - 55 year but when it comes to 1974-75 year in that 10 acres 5 acres had been occupied by our neighbour land holders as SHAKMIDAR after some years the SHAKMIDARS changed in to pattadars .Now my grand father died he made the left 5 acres towards five sons he has in 1995
Here my question is what is" SHAKMIDAR"
IS My grand father lost 5 acres of land what our neighbour land holder occupied
Or else is there any chance to our fathers or I as a grandson to occupy according to law.We are ready to make petition towards that please sujjest me which law is applicable to fight .I am very kind for reply

Changes in will after owners death
My father has been died after gave all his property in my mother's name...can my mother distribute his property among her children????
